Immigration/marriage fraud

I married my wife 2 years ago, she misrepresented herself, she acted as if she loves me and wants to be with me.

she had her interview a few months ago but she didn't tell me that she got the visa, she only told me a month ago, she dragged the process so we will be married for 2 years so she'll get the 10 year green card.

She made me take her on a honeymoon just so she can have photos for her interview, the honeymoon was a disaster, all we did was fight, she ended up staying in a different room.

about a month ago we started fighting because I told her that she misrepresented herself and I told her not to come, that I will withdraw her petition.

before I could do anything she arrived in the US, I don't know where she is staying and she clearly changed her address and received the GC there.

She is now saying that she is afraid of me because I am a violent person and that she never want's to see me again.

What can I do to make her go back and take away her green card.

You can do nothing but let her go, and seek happiness for yourself.....you have no power to "make her go back and take away her Green card".....that's just how it is......

You can't do anything. Now that she has her Green Card, and a 10 year GC at that, it will be almost impossible for it to be taken away. You had leverage before she got the GC, but now, any means to try to have her removed is futile. She is here to stay. This is why it is best to get to know someone as much as you can before marrying and immigrating. 

 

The best advice for you now is to divorce and move on with your life. And if you are wondering, yes, you are still on the hook for the affidavit of support.

 

It sound like she had a well thought out plan. And it sounds like she did research and knew a lot about the immigration system. There are some people who know how to play the long game. The moment you had an inkling of fraud you should have made a move to protect yourself.

This was a two year marriage........by law, she will receive a 10 year Green card.  The I-864 you signed remains valid.......The best thing for you, at this point, is that she obtains US citizenship as soon as possible.

Immediately seek a divorce to protect yourself.....good luck.

Because YOU were the one that sent in tons of evidence that your marriage was real. The government does not have the resources to figure out who is defrauding who. All the government can go by is YOUR word that she is your wife and you two love each other. It is not immigration's fault that she play a good fraud game.

Even then, nothing will happen. Change of address is not compelling evidence of fraud. In fact, we have had members on here who were married legitimately but lived in different addresses because of work or school situations.

If you have solid proof of fraud, you can report it.....but it ends there.......if I were you, I would concentrate on a fast divorce to protect myself legally!!

Immediately Find a competent divorce attorney and protect your assets.......I would consult the attorney today!!

I can only think of 2 cases in the many years I have been on this and other sites and have been involved with immigration where a person was successful in proving fraud. One was because the guy (immigrant) was an abusive criminal. The other was because the US citizen woman had lots of emails, texts, and voice recordings of her husband bragging about frauding her and him talking to his "real" wife back in his home country. Even in the second case, the US citizen woman had a hard time getting immigration to take action.

What if I get an annulment, will this cancel my i-864?

That is the only kind of proof I could imagine that might cause USCIS to investigate.......
