Timeline

I want to apply for my parents. I'm currently living in Pakistan. I was born in the United States but after a year, my family shifted back to Pakistan.  We re visited again when i was six years old and now i flew to the united states for two weeks this year. My question is, Can i apply for my parents while being in Pakistan. I'm  a student here and  I'm not working right now. I want to go back to US after my degree but also want my parents to get their green cards before i get done so that i don't have to live alone. Are there any chances of my application being rejected as i'm going to apply for them from Pakistan and i haven't filed any taxes in America and I'm unemployed. I'm mostly concerned about the fact that i'm going to apply for my parents from Pakistan so won't they have an excuse to reject my application by saying you don't live here so why do you want to apply for your parents?


Also, Can i apply for my husband along with my parents?
Or should i wait?

In order to petition for immigrant visas for your parents you have to be:

- over 21

- living in the USA or moving back at the latest when they move

- able to support them financially or have a joint sponsor who can

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Applying for anyone is based on reunication to the US.   

 

I would apply for your husband first unless you plan to have the resources to support all 3 of them.  Then hopefully you and your husband can get good paying jobs.

 

You (and your joint sponsor) will responsible for your parents' healthcare costs, depending on their age, potentially forever.  Have you looked into that cost?  It can be pretty astronomical.

Is there any way i can go to USA with my husband? and apply for him there? 
We're engaged and plan on getting married soon so would fiance visa work if we get married in USA?
If so, can he live there with me after we get married?
My parents would support themselves. So is there no way i can apply for them from Pakistan?
The problem is, i can't go to USA anytime soon and i really want to  go with my husband after we get married. So is there any way we can go together? And i can apply for him without having to live alone after we get married

Then he is not your husband. Words have meanings.  If you are calling him "husband" especially on social media, immigration may consider you as too married to be single.   K1 is an available option but it has many deficiencies compared to a spousal visa like not being able to work or travel.

 

You realize that most  Pakistani Males undergo extensive post interview Administrative Processing often lasting 18 months or more.

Not in the eyes of immigration.  If they could support themselves they could apply under an investment VISA.  You or the joint sponsor will be responsible for them financially until they become citizens or meet the conditions in which you are no longer legally liable to the federal government.

You can apply for them now, from anywhere.  You will need to fulfill the domicile requirements prior to their entry into the US.

 

Chances are you are going to live without your spouse or parents for a period of time.

 

Since you are applying for your parents, how did you got you US citizenship?   Was it thru marriage or work?  How long ago?

Is ur brother a US Citizen? Only those that live in the US can sponsor. You are filing the petitions, so u are the primary sponsor. U have to establish US domicile, pay US taxes, have income that will support a family of 4. Yes u can get denied for minimal income. 

 

It takes time to file for immigration and comply with specific requirements. Everyone who goes through this process is alone away from loved ones.

Your husband cannot enter the US as a visitor with the intent to stay in the US and adjust status.......expect about a year or longer for him to receive a spousal visa after you start the paperwork.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You are always a sponsor if you file the petition.

It does not matter.  Only US based income counts towards sponsorship.

Have your brother petition your parents.

Brother petitions parents

 

You marry and petition spouse

 

You and Parent move, you, parents if needed to help can sponsor Husband.

 

Husband follows when interview and AP complete.

It’s not clear to me, is your brother a US citizen as well and if so where is he living now? If he’s not a US resident, his ability to support your parents is irrelevant.

File a petition for your husband and obtain a joint sponsor for him

After he receives his visa in about 2-3 years you can move together to the US


You will be wanting to start establishing ties and a home address in the US.  Example set up a bank account, get a drivers license, register to vote, etc.  

 

Earnings in Pakistan are counted as zero towards sponsorship but if you can bank around $65,000 and park it in the US you can sponsor your husband yourself.

Why would it take 2-3 years to get a visa for the spouse? Expected AP?
