old K-1 petition: expired after 6 months?

Hello all,

 

          I need some advice from you experienced VJers.......My fiance (at the time) and I got to the point of scheduling his interview when he decided to end the relationship.  I won't go into why, but this is not an easy process, and we were both under a lot of stress.  We have started communicating again recently.  But after we broke up, I had sent an email to the consulate asking them to withdraw the petition, and they answered that I had to send them a notarized letter asking them to withdraw it, that an email wasn't enough.  I never did send a letter, but this was in April 2019, so I'm sure the petition is expired by now?  Does anyone know how long they are good for?  And if we decide to try again, what steps should I take?  Should I do as the embassy asked and send a notarized letter to withdraw the old petition?  Then we would have to start all over again with a new petition, I assume?  Any help or advise is appreciated.

Check ceac.state.gov, immigrant case tracking,  put in the NVC number,  what does it report?

Yes send a letter to withdraw the  old petition. There have been cases recently on here where a couple withdrew the petition and then had a change of heart. They were told that they could just continue on with it as it was still active and not yet canceled. Turned out to be a big mess. Save yourself the issues and start new when you're ready.

        I checked the status and got this message:  Your case is ready for your interview when scheduled at the U.S. Consular section. If you have already scheduled an appointment for an interview, please prepare your documents as directed in your appointment letter and appear at the consulate on the appointed date and time. Otherwise, please wait until you have been notified of your interview appointment. Additional information about how Immigrant Visa interview appointments are scheduled can be found at: http://nvc.state.gov/interview

For more information, please visit TRAVEL.STATE.GOV. .  
 
         Can you give me any more details about what problems the couple you mentioned had when they continued with their petition.  I haven't withdrawn the petition; the consulate requires a notarized letter, which I haven't sent.

It should be noticed at the interview that you withdrew the petition. Even if not official there would be a note somewhere that you wanted to cancel it. If not and your BF gets to enter the US it might be found out at AOS. So pretty much anything obtain after you canceled your petition can be taken away. Even all the way up to citizenship.

         Thanks for your insights, Ontarkie.  Yes, I agree that we should definitely be transparent about the request to withdraw the petition.  We are planning to go ahead and try for the interview.  Unfortunately, my fiance threw away all of the paperwork I took to him on my last visit, since we broke up.  And like an idiot, I did not make copies 😞  So we don't have the NOA2..........bad news I know, but the embassy should have it.  Now we are scrambling to get all of our documents, again........(sigh)

did you scan anything, store on a computer or online account? at least the #'s would be on the scans.
