My Husband and I recently got married in the states. I came on a tourist visa from Canada. We got married after 90 days. He is a citizen of the United States and I am still in the states. What forms must we file in order to start the adjustment of status?

I am a Canadian citizen and came to the USA on a tourist visa to visit my boyfriend ( who is an american citizen). A little after 90 days of being here we decided to get married and I am still in the USA. When filling out the paperwork for the beneficiaries current address would I put the address of where my husband and I live now and if so should I put the date of living here the date I came 90 days ago, or the date we got married? Or would I put my address in Canada under this section?

 

Secondly, my husbands was born in the USA and his ethnicity is latino (mexican). So for ethnicity I have checked the box "hispanic or latino". But what would I select for his race, as both his parents were born in the states but have a Mexican background.

I am a Canadian citizen, and my now husband is an American citizen. 

 

In December of 2018 My American boyfriend flew to Canada and helped me pack my car as we planned for me to drive my car down for a few months and stay with him to see where our relationship would progress. We got stopped at the border and they denied me entrance as I had a car full of items. Since then, I have flown back and forth from Canada to the USA numerous times. My most recent trip, I came and after 90 days we decided to get married. I am currently still here and we are in the process of filing all the paperwork. For the question "Have you ever been denied admission to the United States?" I have selected yes however, how would I word correctly on the document regarding the incident?

You did the right thing by answering yes.  Just explain it as it was, you were taking "some" stuff that you needed for an extended stay  so you would not have to buy things you already owned.  I went to Canada once,  didn't have a visa or passport at the time, (1999).  Since I had a one way ticket, and a PC and other gear and stuff, I was flagged, interviewed, they looked through my stuff, and I told them I was in a new relationship and wanted to see how it would work out so I didn't know if it would be 1 month or 6 months.  They were very nice, and they got on the phone and got me a 90 day visa letter.  I had my son mail my new passport up to me, and after the 90 days, I went back to the US for an hour, then traveled back in and got another 90 day stamp.  Things have changed I suppose with immigration agents and laws, but stick to the truth, as the truth never changes its story.

Have you made sure to read up on getting married on a tourist visa and what could happen with your AOS?  It is a gray area.  You at least waited past 90 days which is good and you’re from Canada which helps.

I came to the states as a tourist from Canada and my American boyfriend and We ended up getting married. We just filed the adjustment of status papers. I was wondering if I am able to start applying for school before I receive my visa?

Anytime.

You may or may not qualify for in-state or domestic tuition based on the institution and local rules. That's an issue to raise with them.
