Hello,

 

I'm trying to help doing a first individual tax return for someone who's going to have an green card interview (adjustment of status in the US) - he used the work permit to work last year.  Is it okay to claim earned income tax credit for a maximum refund?  I have read last year Trump admin tried to put a limit on this but I don't think it actually was put in place.

The person can claim to be a resident for tax purposes based on being married to a USC. In that case, yes, he will be able to claim income tax credit. Please check the IRS website for specific rules/conditions and how to make the claim.
