USCIS staff are prohibited from providing legal advice...they can only provide input on what is available. Unless Congress changes the law to eliminate the K-3/K-4 visas, they remain on the books. The purpose of the K-3 visa came about to speed up the reunification of spouses since I-130s were taking 2-3+ years at the time. Since the I-130 is taking a year or less in most cases now, the K-3 no longer makes sense and policy was changed to adjudicate both petitions together.

That totally makes sense... I think that leaving it on the books not only confuses people, but also the extra paperwork (K3) is just bogging down the system.

The K3 Is a nonimmigrant visa and so you lose all the benefits of being married to a USC as there are more perks coming in on CR1 visa than a K1.

 

There’s no work authorization and you have to adjust status which is not free and delays everything.  Getting your spouse here sooner sounds great until they get here and can’t work study or drive for several months.  It can kill relationships and make them doubt if they did the right thing. They lose independence and you gain financial stress.  Good riddance to the K3 I say.

Thanks for the feedback, I am starting to get more clarity. When I was doing research online, I thought I saw something about adjusting the status when he got here on a K3 visa... there is just so much discrepancy online.

We chose to get married in Jamaica because all of our family is there... If we got married in the states our main family members would not be able to attend. At that time, I guess we were more focused on the wedding and now we really miss each other ☺️

I've seen posts from claimed former employees (which is totally possible - I only say "claimed" as there is no way to verify it).

I do work for other large federal agencies, and I know that anything that is not in the public realm already is a big no-no that would get me in serious trouble. haha

Timeline

K3 is basically obsolete but what I have been noticing of late is a trend for those who send in the i-129f to get their i-130s processed rather more quickly than normal. This is anecdotal as I have no way of knowing if these persons weren't somehow lucky for another reason but it's still a trend I've noticed ( over on some Facebook groups I'm part of) none of them got their K3 processed but they all had very quick  i-130 processing. So that may or may not happen to you. Let us know what happens.

I have been hearing the same thing that the K3 will be denied but the I30 goes through faster and I will definitely keep everyone updated

I don’t understand what’s taking so long for myself and spouse. I filed on Oct 29th, 2018. NOA, 1 NOV, 2018. Haven’t heard anything from Nebraska service center...Ugh!

I read online that it helps your spouse come sooner, but on this website.... people are saying that it does not speed up the process. However, I did not have to pay an additional fees to file it and the processing time on the USCIS says the process time for the I-129F is faster. So I just gave it a try.
