Spouse in US already do we file both 130 and 485 packet at the same time? (merged topics)

Sorry i am new at this and wanted to know if we file both at the same time? both are in the US

Yes .. as well as the Advanced Parole I 131 and Employment Authorization I 751. These are few free when filed with the I 485   Without them your spouse won’t be able to work or return to the US, if he/she has to travel, until the GC arrives(12-18 months ). The EAD and AP take 4-5 months

Do we have to file the EAD and AP or can we just apply for her green card?

No but she won't be able to travel internationally or work or get a Social Security card.  Banking, getting insurance, and filing taxes becomes a pain.

It either comes with the EAD, which is processed quicker, or you can apply for one after getting the Green Card.     THE AP and EAD are free if you file with the I-485.

Can someone confirm that these are the fees we are paying? Spouse entered on Visitor visa and over stayed 

 

1130 fee is $535 

1485 fee is $1225 

1765 fee is $495 

131 fee is $660

 

Only reason why im asking is we just got off the phone with someone that said they completed the process and it was only 1700. Wanted to make sure the fees are not overlapping.

I 765 & i131 are fee waived when filing based on the i485

I765/I131 filed with I485 do not require fees
