Am I screwed with Affidavit of Support AOS? Help!

 OMG!!!!! I was DYING :))))) My husband overseas couldn't sleep as it's a night there... i need to tell him to chill now. I literally couldn't feel my stomach and had to write you since you were so helpful to see what this was and what to do. Thanks for the comment )))

Pretty much the same wording would be sent to somebody with too little income but a million in liquid assets.  If you did the affidavits/forms correctly, documented correctly and the household income is clearly sufficient, no worries.

Facts are cheap...knowing how to use them is precious...

Thanks so much!!! I'm so happy to have found someone here who is so helpful that's why the first thing that crossed my mind was to update you on the situation. In regard to correctly filling out the affidavits etc, nothing regarding that was said as in fix this or that, so do you think if I made other mistakes, for example, incorrect calculation of the total incomes for us 3 or specific errors on one of the forms, they would have asked specifically for that to be correct or would I just get the standard email even in that situation about me not meeting the requirement? Just trying to figure out if they go into specifics about the form errors or not because I heard that NVC only allows you twice to fix an error before forwarding the docs to the consulate. Thanks in advance, sir.

The email you got indicates they have accepted your affidavit(s) of support and will be sending to the Consulate when your case is otherwise complete at NVC.  If there were mistakes, they would have sent an email detailing the mistakes and asking they be corrected.  They didn't, so no worries.

thanks you that's what I thought. I started overthinking and worrying today in vain. I was going to mention that they accepted everything and just asked me to submit my 1st marriage divorce document and everything else from civil docs, IV form and affidavits were all accepted and there were no remarks or notes by them on the empty side window, so all is good. Sorry for my freak-out earlier :)) Will keep this thread updated for the decision at the end. Thanks to you I learned to do AoS and Im studying to become a paralegal and would love to work in the immigration sphere so this was a great exercise with your help how to do AoS properly for my potential future career and not confuse current income vs taxes :)) Happy early Thanksgiving!

I wanted to double check something please. As mentioned before, I am a self-employed landlord, so I collected $21,600 of rent as my income on my tax return, but after deductions, my tax report for 2018 shows "annual income" of $11,428 after all the deductions on property taxes, etc. I submitted my tax transcript for 2018 with Schedule E (Supplemental Income and Loss), and W-2 where I had received a few dollars from another source unrelated to my only landlord/rental income for last year.

 

So this year, my collected rental $$$ didn't change, so it's the same; therefore, I put down $11,428 as my annual individual income on I-864 for 2019, but I didn't provide any proof of it for 2019, because besides the rental agreement, I don't have anything to submit regarding my annual income until I do my 2019 taxes again where I will report the same income as my 2018 tax transcript. Was I supposed to submit my rental agreement with I-864 by any chance, because I still have time to do that at NVC stage now until it's not too late. I can also submit my bank statement for the deposits, but my tenant (she's an acquaintance of mine) sometimes pays me in cash and sometimes by personal check (sometimes half and half depending on her finances), so my bank statement won't show specific on-time deposits from her. Would this be an issue? Can you please advise regarding the bank statement and whether I should also add our rental agreement to NVC. To wrap-up what I included just for my I-864 are 2018 tax returns w/schedule, but no 2019 rental agreement or anything except 'my word' on the affidavit regarding how much I'm earning this year.

"Income" for the self employed comes from a tax return.  Current income from line 6 of 2018 tax return.  You don't need any further evidence of current income.  There are no questions about 2019 income or "current year" income.  The questions are about total income from a tax return AND...."current income", which will be the same number as line 6 of the 2018 tax return BECAUSE, no matter what OTHER income you have, you ARE self employed, in any applicable context.

 

Don't confuse revenue and income.  Rent received is revenue, not income.

ok thanks for the clarification as always! So would you recommend that I submit my landlord-tenant agreement to NVC as a supplement to my I-864 to show them the rental agreement as a landlord for extra evidence or no need? This crossed my mind today and I wasn't sure if the consular officer might request from my husband my 2019 rent agreement with my tenant acquaintance.

It wouldn't hurt to include it, but it is revenue, not income.
