Timeline

A letter from your ex wife is not going to help anyone. It can actually cause big problems. Your lawyer does not care what issues your ex wife will have with giving you this letter. 

 

You and your ex filed joint ROC while separated. That in itself does not always equal a denial but only if you were trying to work on your marriage. If the marriage was over she should have filed with a divorce waiver. 

 

Filling for USC under the 3 year rule is a big no no when separated. You both here could be in a world of trouble.

Agreed...there are a few ways this could go south for both the OP and even their former spouse.

Yeah I have to admit that my timeline is little bit off. We were physically separated after she already submitted her “removal of conditioned resident” form. So after we separated, I do not want to explain anything to the USCIS. We were remained separated but not divorce because the nature of my schooling and we were not financially stable there to afford a divorce. I just agree to sign her naturalization petition after that but we still remain separated. My lawyer said that if she is willing to sign a affidavit explaining the timeline of our relationship, that could be helpful.

Does the USC sign anything on the N400 under the 3 year rule? I just skimmed through the N400 and I couldn't find any place where the N400 requires the USC spouses' signature. I know this is the case for ROC.

 

Also what did you answer under Part 10, question 1? You should have check marked Separated and that would have led to a denial of the application. If you said Married that could get her in trouble. For you, I don't know.

 

Please someone correct me if I'm wrong.

Yup; it's clear misrep by OP's ex. But the N-400 itself doesn't have a signature box for the USC spouse: https://www.uscis.gov/system/files_force/archive/delete/n-400.pdf (the current version has been in use since 12/23/2016)

She could not legally have filed under the three year union if not in marital union. Being separated and not trying for reconciliation or being divorced would mean the 5 year, not 3 year rule.

Thank you. I couldn't find one either so I'm not sure what OP meant by "I just agree to sign her naturalization petition"

I think you are missing the point...

 

The start time of your relationship is not the biggest issue (people start new relationships while still married). The timeline and your possible cooperation in misrepresentation in your ex-partners case is the issue. If you file a new petition for your current partner and you have to disclose previous petitions, you might end up opening that can of worms..

03/12/2016 Case received by Nebraska Service Center (NSC)
03/14/2016 Text notification received for I-140/I-485/I-765/I-131.
04/08/2016 Biometrics notice received for 04/21
04/13/2016 Biometrics early walk-in completed.
04/15/2016 EAD/AP combo card received in mail.

 

Long wait begins...

 

11/04/2016 I-140/485 cases transferred from Nebraska to TCS
12/01/2016 Prepared package for EAD/AP renewal (expires 04/09/2017)
12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)

I mean, I get what you trying to say. There nothing much I can do. If I have to disclose it I just have to tell the truth, there no way lying around it. Worst case scenario, I’ll move to Vietnam and work and we just have to give up on the American dream, I cannot do anything else about this.
