I have a friend who was originally a  K1 but filed for children after marriage. He just received his 10 year green card (filed 2017).  He filed for the childrens ROC in November 2018. His wife filed for divorce last week.  The wife informed the kids mother about the divorce and stated she is sending the children back. He has moved out and has his children with him. The question is what happens with the kids status.

Let us do the easy bit first, she can not send them back.

 

So the children are on a K2, begs the question if they need to file with a Divorce Waiver or are good to go, going to have to think about this one.
