I would just note again that this does not pertain to the OP's situation as the claimed proxy marriage occurred in MA.

IIRC, officiant was in Pakistan. If permitted by Pakistani law and then consumated, it'll depend on the specifics.

Y'all need to take a step back and reread everything. The OP said that they got a proxy marriage and then got officially married in Sri Lanka later on. That is how I read everything so let me know if I am wrong.

As far as I understood, Sri Lanka is just where they went to have a symbolic ceremony, not actual marriage, since they were already registered as married in Pakistan 2 years earlier

It doesn't matter how legitimate their relationship is if they aren't legally recognized as married where the petitioner lives. They can't petition if they aren't seen as married in the eyes of the US government

Sure, I agree with that, but what i read that he said the Marriage is been registered in home country , so once the marriage becomes legitimate having kids will add up more legitimacy to the wedding, My marriage wasn't skype based but i met my wife through Internet to, so I remember been asked about kids during the Interview . but I think what he needs most that find a way to register their marriage which should be recognized by US govt .

They have to get married first, dealing with whatever that takes, then file.

 

So that is going to take a loooong time, sounds like they have very little time together currently so plenty of opportunity before any interview.

The biggest issue right now, is whether or not their marriage is considered legally valid in the US for immigration purposes. Proxy marriages are not legal in Massachusetts. They must sort that out before they can worry about anything else first, because until their marriage is legal, they cannot do anything. Doesn't matter that it has been registered in Pakistan if it is not legal in the US. Lots of us have met our spouses online, that's not the problem. The fact that they were not both physically present at the wedding and that this is not a recognized marriage where the petitioner lives is the problem.

I don't think the relationship itself was raised as an issue ITT...the legality of it was the question. Children have no bearing on the legality of the marriage here.
