K1 is for those who are not married.

If the marriage is legal in the place where it happened then a fiancé visa is not possible. A fiancé visa is only possible for a proxy marriage that has not been consummated, which is very hard to prove unless one of you has been in a coma the entire marriage or in prison with no conjugal visits?

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Now a US citizen!

Great link

I think solid proof (tickets/hotel receipts/passport stamps) that demonstrate they spent time together and a couple of affidavits might suffice.

Other proof?  We’d need to vet that here first in order to advise if they should move forward.

Read MM’s link about proxy marriages.  They surprisingly seem to have met the requirements as long as the original marriage was legally documented.

Their homeland country? Surely they live in two different countries? Who lives where in all this? Where were they located when they got married?

I wouldn’t advise applying for K1 after a legal marriage has taken place.

In what US state was the "guy" during the Skype marriage?
