Once you withdraw your AOS, you should contact your sister in law to inform her that you've done that, as a courtesy. She may be able to get someone else to provide an AOS and continue on with her green card process, uninterrupted.

She knows i am withdrawing. & she told me that her lawyer told her that i dont have to write a letter because once she gets the interview date she can just tell them yo cancel me, she said she found one already so all she have to do is cancel me & give the new joint sponsor. I told her i dont think u can just do that theres a process that need to be done & that is by me writing to them, & thats what im gonna do she said she cant give me the case no. because it might ruined her application & do whatever i want to do then she said just she hopes whatever im going to do it wont ruined her application. I told her why would it ruin? All i gotta write is im withdrawing. She started asking me why am i such in a hurry? Why i couldnt just wait till the interview? I just ignored it. So i think shes kinda bs-ing me. & thinking that she can fool me.

Does this sound like someone who has your best interests at heart?  

Go with your gut. If she goes to interview before you withdraw you cannot undo this. 

You've been given really good advice on this thread.  I sincerely wish you the very best.  But don't waste a moment thinking about it. You don't know how much time you have to get your withdrawal in so err on the side of caution and go with Immediately.

Her lawyer is wrong----or she's simply lying to you.

She cannot "cancel" it on your behalf.

Hopefully with the news you shared, she is looking for another joint sponsor instead of feeding you bad information.  As to if it hurts her I485 application, that really depends on if she finds another qualified person that will sign an I864 for her.

No judgements here but you seem to be a very gullible person. It is clear she is using you and she won't hesitate to get government assistance once she is eligible to and trust me,you will be on the hook for it. If she can't give you her case number why can't you get it from your brother or better still call uscis till you get someone who can cancel the form i864 and also tell you where to send your signed formal letter of withdrawal. Every piece of advice here so far is all you need to follow. Nothing will jeopardize her application, she will simply need a new joint sponsor. If you don't act fast, you will end up being her sponsor and ruining your credit score, immigration history and may even end up not being able to travel out of the states due to debts. Well let us know how this works out.

You need to be in control here.  It is your future, too.......Call, write, email USCIS and her attorney immediately and withdraw the affidavit of support...

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

OH she’s BSing you for sure.  Buying time. Right now you’re racing an approval clock.

 

Get that withdrawal letter out the door ASAP, document it well, and don’t worry about it.  Her petitioner is responsible for getting her sponsored.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Note to OP: The advice here provided on VJ is more accurate and on track compared to the ones from your SIL and her lawyer (As if they plan to make it go through without you being able to cancel it by waiting it out.) Just as I seen other told you, do make yourself easier by going along what these guys on VJ mention.

You say you don't have the case number/cannot get the case number...

 

On the letter, list her full name and your brother's full name and address so USCIS can tie to beneficiary to the sponsor.  List your full name and your contact info (address, phone number) at the bottom of the letter.

 

Your statement on the letter itself is quite simple.  You are formally withdrawing your affidavit of support for (Name  of beneficiary), and you welcome USCIS to contact you if they need further information.  You don't have to give any explanation as to the "why".  You don't need to have to letter notarized or anything like that, either.

 

Keep a copy of the letter you send for your own records, and mail it tomorrow.

yep.  A financial sponsor until the In-law becomes a USC or leaves the country and abandons her GC.  I would say yes, if she is this adamant now, think how she will be after her GC is in hand.  She could divorce your brother and both of you will have to support her if needed until one of the above are met.  Please keep in mind, to update all those here who have given you sound advice!  We all like to be kept in the loop.. !!

I am usually not commenting that much but other than the obvious implications of signing an affidavit of support, I am very surprised that this communication isn't happening with your brother.

 

For one, it is your sister-in-law and you are cosigning. I would probably do the same for my brothers-in-law because they are my family and I trust them. However, your SIL behaviour isn't trustworthy. I wouldn't discuss this with her anymore - cancel the affidavit of support through the means suggested by others and continue any communication regarding that through your brother. Without having any further details, how about your brother taking on a second job? It is his responsibility and not yours - and they should have given you the full picture rather than just pointing out to where to sign. Yes, you need to do your own due diligence but honestly, I do trust my sisters with my life and while I may read any other contract very carefully, I don't necessarily do that within my inner circle of my family. However, I do know for sure that both would have given me a fair warning about everything and any implications involved. So, your SIL already set the ground with her dishonesty.

But it does strike me as odd that you had no idea what is involved. I’m assuming you had to sign an I-864 form. Both the form and its instructions are very explicit with regards to the financial commitment and how/when you’d be held liable.

I put in the letter top head in bod letters request to withdraw I-864 joint sponsor for (her name) then i put I, my name a joint sponsor, executed on behalf of the person applying for greencard. Can i put why i dont have the case number?
