Offered a job but unsure what 2 do

Unless you can find a joint sponsor who is actually willing to support your everyday financial needs for the 6-8 months it takes to obtain the work permit, I don't think this will work for you.  It would be a much better idea for you to marry, file for a CR-1, and return to the UK.  That way you could be working while waiting for the visa, and able to work immediately when you return here. 

 

Another option would be for your fiancé to come to the UK.

 

US immigration requires diligence in research and reading.  It is time-consuming and expensive.

I hope you haven’t been working at this job without work authorization.

 

Personally, given the financial situation, I think it would be better for you to marry first and then apply for a spousal visa. You can work immediately when you arrive here with your visa as you will be s green card holder immediately. The other two options will have you here, unable to work for many months. How will you afford healthcare? If your fiancé has such little income that you need a joint sponsor, how would she afford to feed another person on her modest income?

 

It’s interesting that you mentioned the job first in your post, and your fiancé seemed to be a secondary thought. Is the aim just to live in the US? Or to build a life with her? I assume you have a decent job, one that pays enough to afford 4 long-haul trips in 2 years. So you might find it easier to bring her to the UK.

To me, this would be even more the reason to go for the spousal visa because you will be authorized to work immediately upon arrival in the US and contribute to the household financially.

Either way, your partner must have a co-sponsor if her income does not meet the requirements to be able to file for you so that is something that needs to be sorted out first.

Welcome to the world of Immigration where nothing is easy, fast or cheap! This is also the reason why I advised you to think about the long term, it is best to approach Immigration with rational thinking.

Don’t jeopardize your Esta by overstaying or something as this might mean that you would have to apply for a visa to be able to visit if you choose the spousal visa road.

You may also marry your fiancé right now, then return home, and file for a marriage visa. Wait until the process is complete, and then you'll be work authorized from the get-go.

 

In the above two scenarios, the fiancé must be able to prove that they meet all financial sponsorship requirements.

 

Otherwise, to obtain a work visa is highly unlikely in this scenario. He'd need a lawyer, a lot of money, and to prove that no one else could do the job besides you.

Why would you do that?  Go get married in front of a JP at some nice scenic spot.  File an I-130 and I-485 from within the US along with an I-765.  Not fast, but a sight better than spending 18 months out of the country. 

 

Um, this is one you might want an immigration attorney for.  I'm worried that financial support might be a problem.

A K-1 visa in this set of circumstances doesn't make much sense. The inability to work seems to be important, so there is little reason to consider a K-1 over just doing AOS now.

Either do AOS and figure out a way to address the sponsorship + inability to work, or marry, go home, and do a spousal visa.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
