We will be filing our ROC application tomorrow and I am really concerned, mainly for the following reasons:

 

1) I use my husband's credit card to make daily purchases such as groceries but he never put me as an authorized user on his credit card account - I just use his credit card. So I have nothing to show that I am making those purchases.

 

2) My name is not on any of the utility bills.

 

This is a list of what we do have:

 

Exhibit 1:

  • Original Personal Check, in the amount of $680.00 for payment of the I-751 Petition to Remove Conditions on Residence + Biometric fee
  • Original Form I-751 filled and signed by both
  • Enlarged copy of USCIS Form I-551 front and back 
  • Copy of passports (current and expired)

Exhibit 2:

  • Certified marriage certificate between both

Exhibit 3:

  • Copies of our current State IDs showing joint residence 

Exhibit 4:

  • 2016 Tax return transcript from the IRS showing Married Filed Jointly tax status
  • 2017 Tax return transcript from the IRS showing Married Filed Jointly tax status
  • 2018 Tax return transcript from the IRS showing Married Filed Jointly tax status

Exhibit 5:

  • Two original affidavits, from USC Mother and Step-father, attesting to the bonafide nature of our marriage

Exhibit 6:

  • Copies of quarterly bank statements of our joint checking account and two savings accounts since our marriage, showing various financial co-mingling such as mortgage payments, HOA payments and automatically withdrawn utility payments, USC's credit card is paid from this account
  • Copy of our debit cards for the same joint accounts

Exhibit 7:

  • Copy of our recorded deed of ownership of our condominium showing us, husband and wife, as owners of the property
  • Copy of the Owner’s Policy of Title Insurance for the condominium showing us, husband and wife, as insured by the owner’s policy
  • Copy of the 2017 Second Installment Tax Bill for the aforementioned property addressed to both of us
  • Copy of the 2018 First Installment Tax Bill for the aforementioned property addressed to both 
  • Printed online copy of Condo Policy details for the aforementioned property showing both of us as the policy holders
  • Copy of Condominium Policy Declarations for the aforementioned property showing us as policy holders

Exhibit 8:

·         Copy of health insurance cards showing us both covered under the same health insurance plan via USC's employer

·         Printed online copy of USC's Health Savings Account overview page, showing applicant as the account’s designated beneficiary and Authorized Signer

·         Printed online copy of our health insurance claims page, showing claims being made for both 

Exhibit 9:

 

·         Copy of USC's 401k account information specifying applicant as his primary beneficiary with 100% share

·         Copy of USC's offer letter for new job effective June 18th, 2019

·         Copy of USC's 401k account information for new job specifying applicant as his primary beneficiary with 100% share

·         Copy of USC's Roth IRA account information with listing applicant as its primary beneficiary

 

Exhibit 10:

 

·         Printed online copy of applicant's transportation card payment information listing debit card of the joint account with USC as the funding source

 

Exhibit 11:

 

·         Copy of flight itinerary for holiday (international)

·         Copy of boarding passes for return flight

·         Photographs taken during the trip

·         Copy of flight itinerary (domestic)

·         Copy of wedding invitation for the wedding of friends 

·         Copy of Boarding passes for the arriving flight

·         Photographs taken during the trip

 

Exhibit 12:

  • Copy of adoption record and photo of both of us with our cat
  • Copies of photographs with friends and family over the course of the marriage                                                               
  • Copies of greeting cards from family and friends addressed to us

 

Do you think I am going to get an RFE? I am so worried.

Seems like a pretty good amount of evidence to me, but I am not USCIS. Looks like you covered all the bases for the most part. Are you on any of the vehicle registrations or insurance policies, those are good evidence to send. Any joint memberships at a Gym, Costco, Sam's club, etc. That is some other evidence, but it seems like you have a good amount. You have the important stuff such as joint bank accounts, the Tax transcripts, 401k info is great along with health insurance, I do not see a problem, and I think you will be fine. I think of it this way, you already proved most of the hard stuff as you are an LPR with a green card, so that is done, you are basically just proving you are still together and living " Happily ever after", the proof that you are not a legitimate couple has shifted more towards USCIS now to prove you aren't still in a relationship or that you were " In it for the green card", and I don't think you have any worries with the evidence you mentioned.

Your evidence is fine, but I would get him I add you as an authorized user on the credit card, so you’ll get a card with your name on it, and avoid any potential issues with using someone else’s card (regardless of permission).  

 

The list they suggest isn’t a “must have” list, for instance, my husband and I don’t have children, so no birth certificates, but we have taxes, banking, credit, leasing, title, etc. which demonstrate a shared life.  You have most of the same stuff, so I wouldn’t worry.

 

If they *DO* ask - just tell them the truth, that’s all.  (And hopefully have a card in your name by that time!)  I still am not convinced that they go line by line on all evidence items.  Why do they care if I spend $100 at Target every week!?

Hi Loren, thank you for your advice... We do not own a car because we live in the city area so we just take public transport.

 

I wrote a "Considerations and Notes" page in the beginning to explain some of this, do you guys think this would be ok?

 

Important Clarifications and Explanations Before Review of Materials

 

1.   Applicant uses the easy to pronounce but non-official English name “xxxxx” for daily life, and this is used to refer to her by family and friends in written correspondence.

 

 

2.    We do not own a vehicle as we live in the __________ city area and we take public transportation which is very easily accessible from our home by foot.

 

 

3.    As USC is the solely employed member of the household, accounts for utilities only bear his name but are automatically paid out of our joint checking account. We manage everything online.

 

4.    Applicant does not use credit cards in her name to keep finances more easily managed. All grocery expenses are conducted through USC's credit card which is then paid off out of our joint checking account each month. This may change in future.

 

5.    USC had just started his new job yesterday, and as the HR processing for health insurance is not yet complete as of the day of this application, we do not yet have joint health insurance information available to us. However, USC has added applicant to his new employer's 401k account as his primary beneficiary even though it has not yet started to accumulate. 401k account and health insurance via USC's previous employer "________", list applicant as a beneficiary and covered spouse as illustrated by the materials below.

Thank you, that's reassuring. We also don't have children. Did you have a very thick stack of evidence by the end?

 

Has anyone gotten approved without an RFE or interview with less documents than the ones listed above?

Was approved without RFE or interview - and we do not own or rent a home, own a car, or have very many joint bills. However I am an authorized user on hubby's credit cards. To make up for the stuff we lacked, we wrote a joint statement, and got those who we live with to write their own sworn statements. Most of our other stuff added in was not too different from yours, with the exception we did include POA's and wills.

Your list of evidence seems sufficient. I have seen others send less and gotten approved. I believe it all depends on the officer who is assigned to your case.
