K1 visa for Libyans

Hi, 

I'm Libyan, live and work in South of France, 

My fiancé is American and we finally decided to get a k1 visa so she can bring me in the US, 

My question is am I eligible to get a k1 visa as my country Libya is one of the travel ban countries?

This is a very interesting question. For most travel ban countries, all NIV/IV visas are banned. For libya, only B1/B2 is banned. K1 is considered a Non Immigrant visa - but is treated like an Immigrant visa (because obviously - you have immigrant intent). I dont have a clear answer for you.  The problem is, that this is such a obscure visa category (libya + k1) - even when the ban was not active, there were only 16 K1 from libya in all of 2017. In 2018 there were 6. So i dont really know. Why dont you just email the embassy and ask?

Ok, so you are in luck. Libya K1s are not subject to ban:

As PP 9645’s visa restrictions are tailored not only to nationality but to visa classification (see Table 1 above), many nationals of the designated countries are not subject to visa restrictions. Tables I(a), I(b), I(e), and I(f) in the appendix detail the new visa applicants that are subject to visa restrictions, while Tables I(c), I(d), I(g), and I(h) detail those new visa applicants that were not subject to visa restrictions due to their nationality and visa classification (e.g. Iranian F visas or Libyan K visas).
