Don't know what to do?! 🙁 AOS APPLICATION - Request for initial evidence (RFE)

Timeline

Hi. We need some advice about our RFE for our AOS application. We got our mail today and they want us to send more evidence about my husband's income. Basically, USCIS wants us to send his most recent tax year. Which we did included on our application. My husband's previous job actually didn't met the 125% of the federal poverty guidelines last year 2018. But he started his new job this year 2019 on January 14. The problem is we don't know what documents we need to submit to them so that they will continue to process our application.

 On the letter also stated that we can use a joint sponsor but we don't have to at least we think because my husband's job now already met the 125% federal poverty guidelines. What do you think we can do?

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

As well as clearly stating what his compensation is expected to be, ie he makes $25/hr and standard workweek is 40 hours, for a total of $1000/week or 52,000 annually. In this case more is better

What is exactly is the RFE asking for?  You mentioned tax information, there have been a few stories recently where folks sent in copies of their returns without the W2s along with transcripts and that seems to generate RFEs.

Did you include I-864 with initial application? What additional evidence did you include with it? Do you have anyone who would be willing to be a cosponsor? It sounds like the only evidence you will have are pay stubs from his current job and they might not find it satisfactory and will want a cosponsor.

I don't know why they didn't see that in our application. We included those stuff already when we submit. But yeah we will submit it again. I think there's no other way. Thanks!

The only thing we didn't submit is his 2017 ITR but we did specifically send his W2s, 1040 of most recent tax years. Also affidavit of support, paystubs, letter of employment of his new job now.

Okay. We we'll include that too. But how can we get that? 

We have his letter of employment which his annual salary is stated and other stuff.

I think the problem is we didn't included the complete 2017 ITR.

But we submit only the W2 and 1040 there.

Yes we did include that. But of course, most asked in that form is his previous income. 

 

I include all the requirements, only thing we didn't is the complete schedule of his 2017 ITR. 

We don't know and I'm sure we don't have to get a Co sponsor. He makes above the 125% poverty guidelines now just this year he started.
