RFE for not answering a question

Timeline

NOA1 Feb 15, 2019,  today the RFE came saying we failed to answer questions on the form, specifically Part 3, questions 2b, 2c, and 4.  Which pertain to arrests.  I don't know how this was looked over, however I assume they are talking about the US citizen petitioner?  Its just one page asking us to check yes or no, then sign.  has anyone ever had this happen and if so, how long does it usually take for it to be resolved?  (no crimes committed btw)

This is about the petitioner and BEFORE you answer please read the information below from another VJ'r.

 

"I failed to mention a 30 year old misdemeanor arrest that was dropped and later expunged.  It was my fault and partially the fault of the company we used to help with the petition.  The governments instructions were very clear.  The company we used was not as clear as they should have been.  Since there are no public records and no possibility of me getting any information, I assumed it was no longer an impediment.  The expungement ordered all records, digital and hard, to be destroyed.  There was no record that I could produce so I failed to add it to the petition.  That was my mistake and we were denied because of the petitioner failing to disclose information in the petition."

Nope, no crimes, a simple case of not checking the boxes although at the time we thought we were thorough.

We received a RFE for not checking ONE SINGLE BOX on the form. We sent back the page signed a day after receiving it. That delayed our process a whole month. 

 

We also thought we were thorough but actually found out the mistake on the day the online status changed to RFE and before we received the actual notification. Must confess I was baffled and it took me a while to get over it. :P

Omg its like a kick to the stomach.  Did it take a month for them to get back to you?  After that how quickly did it progress....

A week after we sent the response, the status changed to received, and four weeks after that, we received NOA2.

After that, everything went as expected.

On an RFE that's a pretty standard timeline. Not checking a single box mite be frevious, but to weeding out the bad guys it is part of the decision process.

ok my next (and hopefully last) question may be frivolous or frivious😅lol  BUT once these questions are answered, and the fact that they didn't ask for any other information, does that mean we'll probably be approved? 😵  I mean, if they wanted any other info, wouldn't they have asked all at once?

No one can with any certainty state that your application will be approved.  Most who reach the same place you're at go onto be approved.  It would be reasonable to think why you would continue an application if you have not completed all your work that is required to render a decision after receiving the answer to an RFE. I wouldn't think sending out multiple RFE makes sense. I'm sure that there has been the rare case it needed to be done, sending more than one but USCIS has never made it a practice to my knowledge. To entertain the thought that they would is counterproductive.  :lol:

They typically issue an RFE for all items they need more information about. However, it is possible they discover something else or the response is insufficient. In that case they might issue another RFE or a denial.

Unless there is a reason for another RFE or denial, it will be approved. The overwhelming majority are approved.

 

And yes, a single checkbox or missed question will generally result in an RFE. Everything has to be documented to comply with requirements, and they don't make assumptions about answers.

Keep in mind that an approved petition is only step 1 of the process.  It's really an adjudication of the petitioner's legal standing to file on behalf of the applicant, if all basic requirements have been met and documents submitted.  The final decision on whether to issue a visa or not is made by the CO after the interview abroad, based on information in the petition but also in the visa application, financial support provided by sponsors, answers to interview questions, etc.  Good luck!
