Hi everyone,

I need your assessment on our recent experience with my 751 which we filed in DEC 2016.

After a RFE and some service requests to move forward, we finally received an interviewdate for February 2019!

Unfortunately we were both sick and could not attend, informed uscis via phone and asked what else we should provide to reschedule the appt. answer: nothing as they will put in a rescheduling request via phone and we do not need to do anything else.

fast forward, nothing happened, no new interview date has been issued until we got a notice saying the case was cancelled as I was a no show!

uscis contact center told us to mail letters to both field office and service center, to open the case again. we did just so, it has been two weeks since our letters arrived and we are very anxious/impatient/confused what to do or how long we should wait until we call again...

long story short: has anyone had similar experiences?

success stories?

what can we do?

its a bit of a kafkaesque story... but also a reminder that everything can take a long ### time...

thanks!

We see this often - no communication between customer service and field offices.

Never ever reschedule an important appointment with USCIS if you can possibly avoid it (unless you're in a hospital, go to the interview). USCIS has zero communication skills and the customer service is a huge joke. It's called the misinformation line for a reason.

I'm sure you'll get it sorted out in the end, but it will take some time. As you know nothing happens quickly at USCIS.

thank you! we were not aware of that communication problem. I do hope so that it can be sorted out. would you wait for a response or call the uscis contact center to find out what the status is now?

I would suggest calling and asking to be transferred over to a T2 officer (they can actually look into the details of your case)...do not just deal with the customer service person who answers the phone---they won't be able to tell you much.  Ask the T2 if they received your request and if you are inline for an interview to be scheduled.

If you get nowhere with the T2 IO, suggest that you pull out all of the stops and contact the CISOMB and open up a case with them. The way you were treated was truly abysmal. https://www.dhs.gov/topic/cis-ombudsman . Additionally, I depending on how the first two suggestions pan out, consider contacting your Federal-elected Senators and/or Representatives. You can do a Google search for their email addresses. They likely have immigration liaison staffers that can also look into this mess. You need some help, toot sweet.

Good luck on your ongoing immigration saga....

Go to an infopass as soon as possible.

Still potentially a waste of time, but less so than dealing with the T2 clowns on the phone, and at least you can ask for a supervisor in person and push to get it resolved.

Worst case, you file a fresh I-751. Not the end of the world.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks).
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE...
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time.
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case.
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied]

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) ....

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

2024: FML. Seriously. I'm done.

OP, sorry to hear that you are going through this :(

I suggest calling USCIS and speaking to a Supervisor...be pleasant on the phone and you won't get push back from the Level 1 rep. ;)

Also, I am certain that, as their automated message states prior to a live agent comes on the phone, ALL CALLS ARE RECORDED FOR QUALITY PURPOSES. If you called, they would have your recording.....mention that to the Supervisor as well.

Monday is Federal holiday.

Involve your congressman or senator’s immigration aide.

Oh, darn it....you are correct, another one of those Monday holidays.

When we were stuck in the ROC shuffle, though not nearly as nasty or protracted as it is now, I tried to enlist the aid of one the Fed. senators's immigration liaison staffers, with little apparent effect. I then contacted the CISOMB, applied for their help. I am not totally sure that it help much. But one week after getting the acknowledgement letter for CISOMB that they would review our case, I received a RFE from the USCIS Service Center (CSC). Call it coincidental? Dunno, except it was coming after about close to a year since we had heard anything in response to our inquiries from the CSC? I kept CISOMB in the loop in all of my follow-up correspondence with the CSC, laying the groundwork for our planned rebuttal to a possible denial, or whatever else nonsense they wanted to throw our way.  Wasn't needed, my family got their conditions removed and GCs in about a month.

The current protracted wait times for processing are abysmal, and just to think they paid good hard-earned money for this type of "service."

Thanks for keeping us on the straight and narrow....

Infopass should be done first.

service request is largely useless.

ombudsman takes about three months.

Hi all, just wanted to give an astounding(!) update.

We would have liked to go ahead acc. to your adviced, but we ould not get an infopass appt, as I am out of the country right now, so we called the uscis center, they kept telling us to be patient, to wait for an answer. contacting an ombudsman would have been on my agenda for August...

yesterday I got the answer in form of an account update which just said "card is in production"

in summary, our case was closed due to miscommunication, we wrote a letter that it should be reopened because their was no wrongdoing on our side and now this out of the blue production notice. is it for real? happy and cringing at the same time!
