Help petition expired before interview - FRANCE

Hi everyone 

 

My fiancé received February 12th 2019 the approval from USCIS (NOA2) with an expiration date on June 9th 2019. 

 

He also received in March (4th) a letter from NVC saying our petition was on the way to the Ambassy in Paris - FRANCE. 

After that We haven't received any sign from the embassy until end of April. 

When we tried to set the interview we noticed the first day available was on June 19th. 

 

My interview will be on June 19th but my petition is only available until June 9th. Our lawyer never had the situation before so doesn’t really know if it will be an issue or not. Every time we tried to contact the embassy on the phone they told us to email them and when we email they told us to call. 

 

Is anyone had the same issue or know what we should do?

The embassy has the authority to extend your petition in 6 month increments until you get your interview, you shouldn't have anything to worry about. I have even heard of some extending a year.

Hi Loren 

do I have to send them or contact them to get the extension or just show up at the interview and hope they automatically extend it ?

The embassy can extend the validity of your i-129f approval 4 months at a time, for up to a year. 

 

Most embassies do this automatically, but not all. To be on the safe side I'd recommend you to contact them and request them to extend it. Also ask them what kind of documents they need if the approval needs to be extended, som embassies require new intent to marry letters etc. 

K-1: 12-22-2015 - 09-07-2016

What I found below at usembassy.com. not sure if it is specific to France or all of them. It was in the FAQ section.

 

Let’s say you finally find a slot open for the K-1 visa interview, but it’s past the 4 months that the I-129F is valid. That’s fine, just be sure to send a quick email to notify the embassy to extend your validity. In all likelihood, once they see that you’re actively scheduling an interview, they will automatically extend your case.

The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed. Here is the official version supplied by USCIS.

 

9 FAM 41.81 N6.2 Validity of a K-1 Petition
(CT:VISA-2165; 08-21-2014)
An approved K-1 visa petition is valid for a period of four months from the date of USCIS action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States.

Could you help me please I’m at the stage where I’m waiting to hear from the embassy in Paris ! My American fiancé got the mail from NVC (May 28th)saying our petition was on the way to Paris... 

My petition expires in August and I m sure now I won’t be able to have my interview by then !.. could you tell me how did you do to extend and what is the embassy’ Email ?
