Has anyone had this issue in their timeline? My friend's kid's father wont give her consent to relocate with the child.. 

What on earth to do?! has anyone made a way to make this work well where one won't have to give up love or a child?

Understandable that he doesn't want to give up his child either.

Without consent from the father, only other option is for the mother to get a court order for sole custody.

Im curious what people do if their ex doesn't give consent at all. Has anyone ended up moving to marry, and then visited kids back in their own country a few x a year? I understand it's hard for both parties, but what does one do when they can't take their kids with?!

One option is for the parent to petition the court for sole custody in the hopes that the child can be relocated to the US.

 

Another option is for the parent to visit as frequently as they can/Skype as frequently as they can, etc.

 

Third option is for the USC to move to the beneficiary's home country.

As a loving parent, it is understandable to not want your child to be far from you so I can see why the father would not consent. The father has a right to be in the child's life.

 

You may have to go to court in order to get consent but even that is not a guarantee.

Tell the father that he will assume full custody of the child then.  Sometimes when the noncustodial parent realizes what it means they become more reasonable to coming up with a compromise that works for everyone

You can try talking to the father and come to an agreement that he will always be in the child’s life no matter what and that you or your friend will bring the child to see him as much as they want or can. Happened to me and my ex finally agreed now he even gave me the custody 🤷🏻‍♀️

The focus should be on what is in the best interests of the child. A parent's commitment should be to the child, primarily.

 

OP, you seemed unaware that you even needed the consent of the other parent to remove the child permanently from their birth country, and that is a requirement of the K2 visa dependent on if the country of birth is a member of the Hague Abduction Convention treaty. 

 

It is a big ask of a parent to give their consent and it is best to approach it with all due sensitivity - outlining exactly how you will maintain the child's relationship with the other parent, and addressing any fears or concerns they may have. If the move to the USA will also be a big cultural change for the child this should also be addressed, after all you are proposing that they adopt and assimilate in to another culture. 

 

If the other parent will not consent then you could bring the case to court but at this late stage (you are almost at the embassy interview stage, correct?) the timing will be wrong for any legal paperwork to be ready for visa approval. In my opinion, it is best to get the consent legally drawn up anyway so there will be no recriminations. It takes time for proposals to be made, considered and any resolutions to be reached. This is why you should have made your proposal to the other parent months ago, ideally before or at the same time that you filed your K1 petition, to allow time for any disputes to be resolved.

Given past threads father might be quite accommodating to taking on full custody.

Having a child together is a pretty big commitment and yes, it means that one parent can't just take the child wherever they want without the other parent's consent. 

My husband has a child from his previous marriage. That is why it has always been very clear to us that I would be moving to the US because there was no way that he would leave the US, with or without his daughter. 

Having a child limits the freedom you have to move wherever, because it comes with the responsibility of being a parent and doing what's in the best interest of the child.
