Is this housing discrimination?

This isn't discrimination.......... Don't use that for everything you get denied for........

Policies vary from company to company. SSN takes around 3 -6 weeks to be verified, officially SSA officers are told to report 2-3weeks. Spoke with 3 different SSA officers and one manager/supervisor. Last two were nice enough to explain the whole process. Did you apply as soon as you came on K1? If it's 2 weeks or less on i-94 left, or you got married before applying, then forget the SSN. If you did apply before marriage and as soon as you came, you should expect it soon. Check SAVE system for status.

Discrimination is singling out someone or some group because of their difference. Company following their policies according to law isn't discrimination, and using that word with that company, might them not to want you even more. if You think that landlord is discriminating, Then DMV is discriminating too, along with banks, insurance companies and so on, because all of them require SSN/ EAD too.

Yes, they want the SSN for the background check. I have explained our situation, that he is here legally and we can show them all the paperwork, but they still just say no.

It definitely feels like discrimination because how is a new immigrant supposed to find housing if property management companies are allowed to never lease to anyone without a SSN?

In any case, if anyone has any helpful ideas that would be great.

Can you just get the apartment on your own?  Ask them exactly why they need his SS. Is it for background check or financial responsibility. We had a small issue in TN. My bank wouldn’t notarize something for my immigrant Nigerian fiancé (at the time) it was due to lack of knowledge and I reported the incident and they had re-training.  Best of luck!

ALL Insurance companies and banks do not require SS. My husband has a bank, life insurance, health insurance, auto insurance and no SS yet

The apartment management companies with whom I have dealt all required ALL occupants and leasees to have a background check and credit check.

@Cheschirecatwait.. How did you get auto insurance without having state DL? NJ DMV's wont even talk without EAD, insurance company can't add someone without state issued drivers' licence.

But a person must prove legal presence to get a driver's license.

With what other sources can a landlord run a criminal background check or a credit check?

This. I recently got a job offer. They needed my name, DOB and SSN in order to run a background check. Running a credit check on a brand new immigrant would not yield results but they may want to do it, just in case, anyway.

The one company I talked to (company policies depend on the specific company) required spouses to both be on the lease.

Correct.  My wife arrived in the US on 6/22/17.....she received her SS card on 7/3/17..........we signed a new apartment lease on 7/9/17.........there was no issue with the background check.....
