K1 approved but didn’t travel.

Hello! 

I got approved for a k1 visa in June 2018 and got it cancelled in November 2018 because of some problems. I couldn’t travel to the US to get married in that time. Me and my fiancé want to get married soon and then apply for CR1. Can we apply ASAP or is there any time frame in which we have to wait to apply for CR1 now? Thank you

You can apply ASAP. Make sure you hold onto K1 paperwork. You just never know if you'll need it.

I don’t know why the lawyer is asking to wait until December to apply. He says we have to wait for a year until after the visa was expired. Doesn’t make sense to me.

You can apply as soon as you are married and have a marriage certificate that is translated into english

Uscis is telling me that I can apply for CR1 after I make sure my previous file is now closed. I’m not sure how to find that out.

USC petitioner writes a letter to USCIS withdrawing I-129f petition. It can be done at the same time when filing I-130 petition or beforehand.

Even if the visa was approved and stamped on the passport?

Correct.  You don't have to find out. Send a letter withdrawing the I-129F in the same envelope you send the I-130 package.
