My interpretation is he is not going to meet up with her until May.

I have been told by an attorney that having a child together is very strong evidence.  Both your names will be listed on the birth certificate so that is good.  You do seem to be missing the marriage certificate which is usually a requirement.  When we did our original GC interview the officer led me to believe that if the evidence at the original interview was strong enough we might not be called back for an interview at the ROC.  When we filed for ROC we did not have any joint financial accounts but we had three years of tax transcripts, a marriage certificate, joint health insurance, and some photos. Oh and my spouse's birth certificate and my GC.  That was it.  We neither received a RFE nor did we get called in for an interview we just got approved (just over a year later).  I think it had also been pointed out that once they get your package, if it is complete, you will get your I-797 with an extension shortly thereafter (mine was issued the very day they received my package).  So provided they get your package and the form is complete and the check is fine (they don't look at the evidence just yet) you will have the extension letter to carry with you shortly.  Or have it sent.

 

I think the point I am trying to make is that we often hear only the horror stories on here but not the times things went smoothly so I am just sharing my experience which went fairly smoothly.  So take a deep breath and give it a couple of days before freaking out.

jeffery and others, thank you so much for your replies. I also appreciate the warning posts because things can escalate quiet fast so i need to be on guard. We're lucky to have found out before it expired. As for re-sending the document, my wife filled out two forms and I still have her signature. I have another fully complete form in blue ink. 

 

I called USCIS and they said I should receive the notification via text or email because I filed G-1145. He said I will not be getting a physical copy apparently because the email notifiation will include the comment about it being an extension. Totally new news to me. He also said not to worry too much about RFE at this point because you may not necessarily receive it. Apparently the blue ink is okay as well even though I sent mine in full black as per instructions. 

 

now i am waiting for USPS to update my tracking. The package should have reached by monday evening and now it's ending tuesday. 😬

Are you sure it's OK to use blue ink? One of my friends just got his first passport application rejected and sent back because he filled it out in blue ink not black... I'm not sure I would trust what one person said over the phone versus what the official instructions say...

Just FYI- a conditional GC is a special kind of GC. Generally your status is your status until taken by an immigration judge- however the conditional GC has special rules. One of which was mentioned- failing to file ROC means (to USCIS) that you no longer want your status and failure to file ROC is taken as you surrendering your status. Now nothing is quick or automatic with USCIS; so for those that fail to file- nothing happens the first day, nothing happens the second day. Nothing will happen for a long time on average, but at some point USCIS will forward your file to a judge who will 'confirm' you didnt file and rule that your not filing means you dont want the status and officially strip it from you. The delay in this happening is why people are able to file late (sometimes even up to a year late) and still be OK.

 

In order to show you have status still when your conditional GC expires you need the expired card + the NOA. Everyone gets a NOA- even those that file a G-1145. Recently there has been a lot of petitions filed- so the wait time for the NOA can take up to 60 days to receive. Some people never get one and have to ask for a copy. Hopefully the OPs NOA comes in a timely fashion.

 

The wife will not be allowed to board the plane with out her expired GC and NOA extension letter. Embassies do NOT give 551 stamps, and she can not get a boarding foil unless she shows they proof of her status being extended (copy of the NOA + expired GC). If she has both those documents she does not need a boarding foil. A boarding foil is for someone who lost their documents. its a one time use only thing. So forget about going to the Embassy. They can not help her with any of this.

 

Her options at this point is to return home before her card expires, or remain overseas after the card expires but then she can not return home until the NOA arrives (will be mailed to US address) and then someone sends/brings her a copy of the NOA. She also needs to have someone watching the US mail for the biometrics notice. If she is still overseas when the biometrics appt comes it will have to try to be rescheduled. There is no guarantee they will reschedule or how long it could take to get biometrics rescheduled. Biometrics must be done in the US. Typically biometrics notices are sent between 30-120 days after filing and give you at least 2 weeks notice in advance of when the appointment is.

 

Since the ROC packet sent was very minimal it is most likely an RFE will be issued at some point. RFEs are generally not issued until someone actually goes through the packet and sees the evidence is lacking or needs explanation. There is plenty of time to gather up more evidence for ROC. OP- read through the ROC forum and see what other people have submitted. You probably have more things you can add. At the very least you can include a statement of your financial situation and how she is a homemaker with no income. 

 

The way the ROC process works is you send in your packet, the mail room processes it and a NOA is issued. Then it sits for a very long time. When an officer gets to it and actually looks at the contents they will issue a RFE if needed. If they are not satisfied with the RFE response they will schedule you for an interview. If they are not satisfied at the interview you will get a NOID (notice intent to deny). You may also get a second interview. It will then go to the immigration judge. Point is there are many many chances to submit evidence and explain things. 

 

Do NOT send unsolicited mail. There is no guarantee it will make it to your file. Send stuff if you want but do not be surprised if it doesnt make it to your file. So keep copies of what you send if you do decide to send anything, but honestly you are better off waiting for the RFE. 

 

RE black ink/blue ink- USCIS uses scanners. Blue ink sometimes doesnt scan. Very few people though get their forms rejected for this. It can happen but usually ink color is a non issue.

Brief suggestion and the best option you have... Have her come home literally tomorrow and wait for RFE. Everything else = unnecessary risk = possible AOS complications = Too much money and effort wasted = possible revocation of LPR status << $1000 ticket avoids all that.

Who was your attorney for the whole first process???? (if you got one). That is something they make VERY CLEAR once you get the residence for the first time. "In two years you have to do it again"

what a twist. 6 days later, US Priority mail package is still showing it is in NJ processing center. It's possibly lost since its 4 days too late.

 

What if I send another package and cancel the first check in case the package goes after a few days? Will this cause problems. Man what a bad roller coaster ride. USPS is absolutely terrible. The customer service wait time is longer than USCIS and it says to call back if package hasnt arrived by 4/4 .....

You could do this: have that package intercepted and just send out another via UPS, FedEx or other express mail service. It'll cost more of course but since you're already in such a tight deadline situation, this might make the most sense.
