Can I wait until my spouse is in the USA before filing 2018 taxes?

Did you know that there are CAAs located in many foreign countries.   Might be one near by

What I did before was filed as married filing separately and wrote NRA as mentioned in the previous post. You don't need an ITIN for her right now. Once your spouse is here and have an SSN, you can amend your tax return and most probably you will receive a refund from the exemption.

 

I was also advised to defer the filing until my wife is here but this will work well as long as you don't owe any money to the state/IRS, otherwise you will pay some interest, etc.

Is there any risk in filling with NRA written? H&R block said the IRS might reject it.

 

Someone also told me to defer. I am ok with doing that since I do not owe but won't that be an issue come interview time? VJ has mentioned the possibility of a CO issuing 221g for not having them completed.

There is no risk if filing MFS.

IRS Publication 17 specifically states to write "NRA" in the spouse's SSN field....when filing MFS & spouse does not have a SSN/ITIN.... They will reject it if you try to e-file.......you must mail it.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The rep I was speaking to says their software has input to enter NRA when filling MFS. She was confused when I told her it may need to be mailed in. Will that be considered e-filing and rejected? Or is e-filing using something like TurboTax?

The IRS will not accept tax returns with "NRA" in the SSN field.......must be snail-mailed.....

IRS will not allow electronic filing of returns with NRA as SSN.  If you put NRA as the SSN the return must be filed by mail

Print it and write NRA. Most good tax preparers are aware of this and actually Hr blocks software has it in the system. I just did this with hr block and I mailed it.

You mean the H&R software allows you to enter NRA? Then you physically printed and mailed to the IRS?

 

I will have to verify with my tax preparer how they will send the taxes. They have told me that their software allows them to enter NRA. I don't know if they will e-file or use traditional mail though

You can’t e file unless the spouse has a SSN. Your only option unfortunately would be ITIN or mailing. The software won’t let you efile anyway, just print.

Any return that has NRA as SSN is NOT electronically fillable.  Period.

You can also use Turbo Tax like I did for 2015 & 2016:

1.  Select "Married-Filing Separately".....enter 999-99-9999 as spouse's SSN

2.  Prepare taxes as normal.

3.  Print hard copy of 1040, etc.

4.  Use whiteout to "erase" spouse SSN.

5.  Hand-write "NRA" in spouse SSN area.

6.  Mail return to IRS.

 

Simple procedure, but worked perfectly.
