Wife Claimed me as Nephew in Tax

Are you her nephew? If you aren't then it seems strange she chose that designation.

Your wife will as mentioned have to amend her taxes. And be prepared to owe back a good amount of money... but more than that, there could be legal ramifications for her because she knowingly lied about her taxes.

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

None of your tax filing make sense.

 

A "single individuals" filer has higher tax brackets than "Married Individuals" filing joint. Also has higher deduction as filing Married joint filer.

 

Even filing as "Head of Household" get more tax refund.

 

The only two tax credit for a dependent (Nephew) are "Earning Income Credit" and "Child Tax Credit:

The only way your wife will qualify either your age is under 17 by the end of the filing year or a full time student under age of 24.

 

If that is the case you and your wife need to file a 1040X for 2017, with the correction amount own plus penalty.

This happened to my neighbor. I will message you privately on what happened and how she cured it as it is too much to post here.

The only way I can think of the wife obtaining any tax refund increase would require the "nephew" to have a SSN........in which case, she could have received the same benefit by claiming him as "spouse"............this is really weird....and sounds like tax fraud, not some kind of filing "mistake"....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yeah definitely not a mistake...she willfully committed tax fraud. Hes gracious enough to come here for help and seems pretty stunned she would go to this type of extreme just to get a larger refund. How uncomfortable. Sometimes you never know who you are marrying sadly.

She's my wife.She was only interested in larger refund.

Sadly all the money is gone.

How is she filing this year? Did you give her your 2018 w-2? 

Why doesn’t she give you her w-2 (they’re all out by now), any bank or other 1099 forms and you find a cpa and you file taxes this time - married filing joint of course.

July 22, 2017 (Day 08) - Biometrics appointment scheduled online, letter mailed out

July 25, 2017 (Day 11) - Biometrics PDF posted online

July 28, 2017 (Day 14) - Biometrics letter received in the mail, appointment for 08/08/17

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

Aug 14, 2017 (Day 30) - Online EGOV status shows "Interview Scheduled, will mail appointment letter"

Aug 16, 2017 (Day 32) - Online MYUSCIS status shows "Interview Scheduled, read the letter we mailed you..."
