Immigration REQUIRES a great deal of knowledge, PLANNING, time, patience, and money.....a lack of any can result in less than desired results.......as was the case here, imo.

No, K3s are all but gone..........They are almost always administratively close in lieu of a CR-1.......there is a chance there will be zero approved in 2019.

Although the K-3 is still mentioned in current US law, it's basically obsolete. Below are the number of K-3 visas issued worldwide per fiscal year; https://travel.state.gov/content/dam/visas/Statistics/AnnualReports/FY2018AnnualReport/FY18AnnualReport - TableXVIB.pdf:

• 2018: 6 visas
• 2017: 15 visas
• 2016: 102 visas
• 2015: 182 visas
• 2014: 392 visas
• 2013: 144 visas

Probably near 0 K-3 visas will be issued in fiscal year 2019.

Preparing the I-129f for K-3 is totally a waste of time.......there is no "fast track" in the world of immigration unless a person qualifies for direct consular filing.

Not for several years.  THAT attorney appears to have no current experience with spouse immigration processes and procedures, or is so unethical, they would charge for filing a second petition that is dead on arrival.

The K3 is no longer used, and even if it were, it was no faster than the CR1. Also, you cannot petition for a US visa in the Philippines unless you, the US citizen were to currently live in the Philippines for 6+ months first to qualify for Direct Consular Filing, and still it is obtained from the US through the Philippine's US consulate NOT the Philippines, the Philippines cannot grant your wife a US visa. Either way, living in the US you do not qualify for Direct Consular Filing. You can't "fast track" anything. You, the USC, live in the US, you must petition through the US, and you cannot "fast track" it. There is no option for "fast tracking", other than an expedite, which you can only obtain in extreme emergency situations. You must go through the normal CR1 process like most everyone else.

If you want to get your wife here the soonest you need to file the I-130 for a spousal visa.  K3 is dead and you are already married for a K1. 

 

In your original post it sounded like there were also issues in the marriage.  Have you guys worked that out?  Is she ready to file and prepared to wait the year plus to come back?

 

If you are going to use an attorney you are just going to slow things down and probably keep getting wrong info.  Everything you need to know is right here in the forums.

Everyone here has been great here. We have been working out the marriage issues. What a support group to have to get thru this. 4 years ago when we did the k1 some people helped me thru that from this site also. Each one of your contributions has been great. God bless all of you! Thanks......I will start the process and ask questions when they come up.
