K-1 Visa from phillipines. Annulment or divorce to file?

"Could be charged"  .. someone must first file a complaint .. "ex spouse"  maybe.

 

U.S. citizenship is good.   Dual citizenship if you are trying to dodge this possible issue is of no benefit .. reason being if the filipina enters the Philippines using the Philippine passport U.S. citizenship benefits don't exist .. only if entering the country using the U.S. passport does that "protection" exist.  

 

As an added note dual citizenship is not necessary for living in the Philippines long term .. the SRRV was designed with former filipino citizens in mind .. gives them privilege for living long term in the Philippines without the issues of dealings with the Bureau of Immigration B-S.
