If #3  is the way it went down then the divorce in her home country is valid as the first marriage was the only valid one. No need to go to Florida and do another.

 

Thank you for the questions:

1-They Married here in their country. Then she went back to Florida,because she was living there and after almost 3 years o so of marriage she applied for the k-1 visa.

 

2-The were married alredy in their country and the when he went to Florida,they married over ther too because the just had 3 months under the k-1 to do it.

 

3-She went to the states when she was a girl with her parents,thats how she obtain her citizenchip. Then she met the husband years after she became a citizen. The husband was the one who went to Florida under the visa. The 15 years are the ones they being married all together 2003-2018. And yes,they never fix his status,he never got his green card. He is back in his home country since 2011.

Wow 15 years.  That it is a long time to be in limbo.  Especially in Florida.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Yes, I think #3 happened as well. The woman was a US citizen to begin with. Then they got married somewhere. Then the woman sponsored the man on K-1 and the man entered on K-1, got married in Florida, somehow never adjusted and was deported. 

 

I don't know the consequences of lying on the first K1 is, for the US citizen. The K1 spouse is probably done for, not a chance of getting into the US. 

 

It's not bigamy, since the OP (or friend) didn't marry 2 different at the same time. It was the same person.

 

I don't think there is an issue with divorce (doesn't matter where, just if the divorce decree is not in English, need translation). 

 

The problem to the OP (or friend) is the misrepresentation on the first K1, but again, don't know what the penalty of that for the US citizen is, but I imagine if USCIS knows about that first K1 that was misrepresented, they won't be too kind to the second K1 or CR1 petition from the same petitioner.

I don't think you are understanding anything we are saying. No one said she had to go to Florida to divorce. Her divorce in her country works.
What we were speaking to was the lie that your friend got married and filed a K1 which is for not married folks, because it was faster.

 

If she filed for divorce and it was granted that's all she need to. She is divorced.

Yes this is a mess. If it was really your friend I think the outcome would be better. I'm afraid that with it being your husband it is a much bigger problem. 

 

 

There used to be that online attorney Laurel Scott i think? Anyone know if they still offer free advice? I know this attorney was referred to often and they won't beat around the bush. If they are still available you need to chat with them. hopefully one of our other members knows if they still offer free chats. If not I would still pay for a free consult with a very good attorney. Not just any attorney either.

Laurel is still around but never did free advice, well as part of I2us defunct a long time ago.

 

Misrep and Illegal presence, would be a hell of a waiver.

Thanks for that info. The OP needs to chat with a good lawyer I know Laurel was recommended often for tough cases.
