The USCIS has issued a Ruling, effective April 17, 2007, that gives adjudicators flexibility in determining the length of time a petitioner or applicant has to respond to a Request for Evidence (RFE) or a Notice of Intent to Deny (NOID). Currently, the standard deadline for response to an RFE is twelve weeks (84 days). NOIDs must be responded to within thirty days. Under this regulation, the USCIS will determine how much time should be permitted in any given case, with maximum possible time being what is now the standard response deadline. That is, adjudicators will set deadlines for both RFEs and NOIDs that could be up to twelve weeks in case of RFEs or up to thirty days for NOIDs. No extensions of time are permitted.

Hi everyone, 

 

I came here to find some information on what I need to bring to my consulate interview in regards to the I-134. I am applying for a K1 visa and only have my fiance's W2 along with the signed I-134. Could you tell me what must I ask him to send me in addition to these forms? Should they be originals?

@Greenbaum we sent affidavit of support with with assets of USD$220000 ish, no debt at all(owns his house and car) , USD 30000 in savings,  is making USD 4000 a month, doesn't have kids or dependants and the embassy said they want a joint sponsor. Is this normal?

W..T..F..!!! That's insane. I have never heard such goulash before. 98% of applicants don't have a stellar financial package as he does and they pass with no problems.  Even the embassy in the Philippines doesn't ask for any financials during the interview and he needs a cosponsor. How nuts is that!!

 

Unfortunately,  he who has the gold makes the rules. He has to comply if you'll want the Visa. I wish I could tell you that there is something you can do about this but there isn't.

Two things. 1. You asked this question over in another thread and I believe you have your answer.  2. You haven't completed your profile so we don't know your embassy and without knowing we could give you the wrong answer as each embassy is different. Bonus. 3. Go to the subforum for your Region and ask this question there you'll get a better response

@Greenbaum can a inmigration  lawyer dispute to the embassy the fact my fiance has enough income to support me while in the US and they are saying the opposite? Or should we go to NVC or USCIS?

No to all.  An attorney cannot appeal and the decision is made by the consulate and NVC or the USCIS have no influence

Decision has not been made, we are in admin processing still. I feel like if we dispute we'll end up denied😭

The only thing that will influence the decision is evidence.   What evidence did you provide and why do you believe they have  concluded that it isn't enough?

My fiance didn't made enough income last year, but still he had more than enough money to buy a condo by himself without any loan, and still has worth more than year salary savings

 

Has net worth for more than USD 200000, had no debt at all, has savings and, Rents a room, work for more than  minimal wage. 

 

So I think it is all about last year income

We don't always know the reasons completely. Denials will have a short explanation. When in AP you never know which way it will go so don't think it will go south when it really may get approved is just overthinking. If they indicated that you were approved at the interview then chances are you will be fine. If you didn't hear those words then you will need to have patience and live through the AP process. Since none of us were there it's hard to opine as there are many "roads" the interview can travel down. At this point I am not sure why you think you will get denied based on income.
