Refund - paid twice to USCIS

Hi all,

I filed a Re-entry permit for my mother (Application for travel document) a couple of months ago. I paid $575.00 fee online (BIG  mistake, paid with my credit card online I should have re-searched more). I sent the package to USCIS with a copy of my transaction (payment details). Weeks later I got a Rejection Notice, the reason: Payment fee was incomplete or not received and it has been rejected.

 

I sent package back, this time I filled G-1450 form (Authorization for Credit Card Transactions) with the correct  amount ($680.00). From there, everything went well. Process is fine, my problem is, my first payment was never refunded.

 

Later on, I found out  there is no online payment for Re-Entry process (I don't know what was I thinking, I shouldn't have paid online). 

 

Since then, I called USCIS multiple times, no help. Last, they entered a claim for me, I got an email saying to send a letter explaining what happened and to include a copy of the first transaction for review. I am sending the letter tomorrow, but I don't understand why they didn't refund it as letter said it was.

 

I read everywhere USCIS does not refund,  will only make a refund if USCIS makes an error or a fee was improperly collected. A refund may be issued in the event USCIS does not meet the guaranteed 15 calendar day processing period for premium processing under specific conditions, or due to a USCIS error (as identified in the CFR Section 103.7). No refunds or returns will be honored for user errors or in the event of an application cancellation or withdrawal request.

 

Am I out of luck? Anyone with same issue?

From what you've written above, it sounds like the first payment never actually went through/was taken from your account....are you saying the first payment actually shows up as processed when you look at your credit card statement?

Do what they tell you. If they determine they did make an error (which it seems they did by sending you paperwork stating your first payment was not complete when it was- leading you to make a second payment) then they will eventually send you a refund. You should not have sent the second payment if you saw the first payment went through however.
