Teacher on visit in USA b1/b2

Timeline

We are looking to determine the best visa options for Teachers to work in the US. We have anecdotal evidence that the J visa is used but need your advice / opinions on possible options & the Prerequisities. My friend teacher is currently USA on b1/b2 but wish to stay here and work as a teacher.

Not going to happen.

No one, absolutely no one, will hire a teacher without legal working status in the US. B1/B2 is tourist visa. Not work visa. Unless that "teacher" gets married in the US, adjust status, receive Green card - not happening.

 

2. There are work visas, sure. But teacher doesn't have many chances to qualify.

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Sorry, but your friend will have to return home and get a work visa.  It's unlikely that he can find a US employer to get him through the process while he is visiting the US.   

 

The US employer petition for him for a work visa.  The US employer takes care of the legal requirements to get the visa.  There are strict requirements.  It's not fast.  And it ain't cheap for the employer who must pay for the process.

It is the J-1 Program.   They use it here in Arizona often as there is a significant shortage.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I dont think that J1 Visa is for regular teachers either. Unkess your friend is a researcher or a professor.

What is it with Indian nationals on a b2 trying to AOS?  Why why?  OP appears to have done the same, arriving on a B2 and marrying a USC. 

 

Dude, tell your friend to return to (India?). If s/he wants to live in the US on some sort of visa, they apply for an appropriate visa at a US consulate.

Something the friend needs to discuss with the friends Employer.

Same sex couples.  They have decriminalized parts of same sex relationships but not marriage.

Different religions and cultural reasons as well.

Normally Cultural means they can not do a K1, US Consulates are under US laws.

What’s wrong with marrying on a b2 in the US then returning home to await processing? No one back home needs know what’s going on if they don’t want to tell them.
