Other nationality/passport for DS-260

Some background, my wife is a Canadian national  with a valid Canadian passport who is in the process of immigrating from Canada to the US via CR-1 visa.  However, she was actually born in Venezuela and immigrated to Canada when she was 14.  Our understanding of Venezuelan law (it's quite murky these days) is that she was definitely a Venezuelan citizen at birth and is technically still a Venezuelan citizen now.  She has passport from Venezuela but it has long since expired (and getting it renewed is hopeless these days).  She has been traveling exclusively with her Canadian passport for at least a decade.

 

We're currently filling out form DS-260.  We put Canada as the main Country/Region of Origin but there is then the following question:

"Do you hold or have you held any nationality other than the one you have indicated above? "

 

We put "Yes" and "Venezuela".  Instructions were pretty clear here.

 

Next it asks:

"Do you hold a passport from the country/region of origin (nationality) above?"

 

We're not sure how we should answer this.  She had a passport at one point but it's long expired and no longer valid.  Should she put "Yes"?

I would put no. That Venezualan passport is not a valid passport. It has expired

If she still has the passport and you can give the passport number I don’t think it would be wrong to say yes... but if she doesn’t have access to it, the tense of the verb “ have” is present tense ... doesn’t say “ have or ever had “ so say no

If I were you,I wont even say a word about Venezuela in my application to make things easier for me.

Terrible advice........ALL questions must be answered truthfully.........Lying and misrepresentation can result in severe consequences.

Thats not lying.

Its about avoiding complications with your processing.

If his passport was valid,thats a different story.

Well, the question states: "Do you hold or have you held any nationality other than the one you have indicated above? "  So I think omitting the Venezuelan citizenship would constitute misrepresentation.

Yes, it's lying.  Pure and simple.  Remember, you said don't mention Venezuela at all.  They MUST "mention Venezuela" for the first question, but the answer to the second question is no.

 

To the OP, no, you wife does not hold a Venezuelan passport at this time.  I know it doesn't use the word valid, but it is understood that to hold a passport is to hold a valid one.  One that hasn't been valid for many years might as well not exist.

I think I have learnt something atleast lol.

But I was trying to avoid any future problems if asked about Venezuela.I hope you get what I mean.

Like the Passport not being Valid.

So, I'm Venezuelan.

 

You don't stop being a venezuelan jsut because passport is expired.

You have to quit you right to citizenship by birth. And even if so, you will ALWAYS have to declare your place of birth -Venezuela-.

 

So yes, it's a really bad advice, and FYI being Venezuelan doesn't add any "complications" with the processing.

You never make anything easier in this process by lying.   Lying CAUSES problems.  It does not avoid them.  Words to the wise, with regard to your own process.  Get all thoughts of anything but truth telling out of that mind of yours.

Hubby had the same issue but he was born in Ukraine and also have a Russian passport because of Russia illegally taking over Crimea, and extended citizenship to those that were registered in that area. Where he was born I just stated USSR (he was born before 1991), and anything else pretending to that area as Ukraine per USA Government Law. Sadly when hubby did his side of the paperwork without me looking at it (US Travel docs website.....) He placed it as Russia.

We listed Russia as his primary and Ukraine basically as the secondary.

Yes, Ukraine.

NO, (since it expired in 2016 and has yet to get it renewed.)

 

We are in AP because of what he does for a living, not per the above.
