so, the embassy has received your filled out ds5535

currently many from morocco and several other countries are getting this 3 page form to fill out especially if you live in Fes or the northern section of Morocco

unforunately your K1 is refused and the case will come back to the US and be allowed to die out

at this point it is best (if completely serious) for the USC to return to Morocco and marry and file CR1

She should withdraw the K1 application in her cover letter for the CR1 application asking USCIS to continue the security checks that were  prompted by the ds5535

Basically anyone getting this form is waiting over a year and some wait for 2 years to hear any news on the investigation

A CR1 will take 12 to 14 months from application to interview (at least right now it is) so by asking for the ds5535 investigation to be continued with your new CR1,   you can be months ahead of the process 

 

for an approved visa from the Casa embassy

this is not fast

this is not easy

this is not cheap

 

the Casa embassy takes all applications and interviews very seriously so now you must show you are completely serious and patient and willing to marry in Morocco and see this thru

 

you can search on this site for past posts of ds5535 or look to the group on facebook reguarding this issue

Going to have to somewhat disagree with the post above. There have been several K-1 visas approved after being requested to submit the DS-5535. Processing time does seem to vary a lot (I've seen it processed as fast as 3 months, but also seen it take over a year), but in the end, the visas are generally approved.  The 221g is usually just a temporary refusal in these kinds of cases while they process the DS-5535.

 

I don't agree that withdrawing the K-1 and marrying and filing CR1 is necessarily the right option at this time. By the time you interview for the CR1 visa, they could potentially ask you to submit the DS-5535 all over again. I do agree that you should join one of the numerous Facebook groups that discusses DS-5535 processing times.

221g with ds5535 is a temporary refusal.   Unless the case is officially refused and returned to NVC..then USICS it will not die.   If at some point during the background checks they decide to return the petition then I would follow the advice above but at this point you just have to "try" to be patient and let them complete what ever it is that this form accomplishes.

This case is dead

just as the one who was given the paper that said welcome to the US and the emailed the ds5535

2 months later the case was returned to the US

In this case it is probably the name Mohamed that prompted the inquiry as it is so common

Delays in Visa Issuance Abroad

On May 4, 2017, the U.S. Department of State published notice that consular officers will collect additional information from certain visa applicants “in order to more rigorously evaluate applicants for terrorism or other national security-related visa ineligibilities.” Among the additional information to be collected in the new Form DS-5535 are the names, addresses, and dates of birth of all siblings, children, and current and former spouses, or civil or domestic partners. At a minimum, the additional data points provide leads that may require additional time to investigate and can be expected to add delays in visa issuance.

Applicants required to complete the DS-5535 must also provide their 15-year travel, employment, and address history; and their social media platforms and identifiers; and all phone numbers and email addresses used over the last five years. The volume and level of detail requested increases the likelihood of inadvertent omission or factual error in the completion of the Form DS-5535, as applicant recollections fail over time and many applicants simply may not maintain records for 15 years. Applicants should ensure that all information provided is accurate – not merely a casual “best guess” – in order to avoid a potential finding of misrepresentation during the visa application process. A finding of fraud or misrepresentation could result in a lengthy or even permanent bar to future admission to the United States.

With new social media details now under the microscope, it seems possible, even likely, that an applicant’s social media “friends” could become a reason for visa denial, even if there is no real friendship involved.

Many do K1 as the Moroccan is anxious to get out of morocco

and after denials, they do a CR1 or give up 

and often the K1 people exchange ID's and whatsapp so they communicate thru those areas 

the frustration is no one can really change the denial so i think they quit posting when they try for spouse visa 

truth be told they don't like to reveal private matters and when we start asking for more information about a case ,  they find it offensive

and they don't like the answers

I mean i talk to many going thru this process on whatsapp as it is faster 

waiting here for a response or a person to come online is sometimes slow

good info here from experienced people 

but if some moroccan or USC needs a lot of information,  i use the cell phone and whatsapp to talk 

 

and you can never really know a person till you live with them and that only is if they communicate
