Name Change Question ⚠️⚠️⚠️

Timeline

Okay so I was previously married, now divorced. Didn’t change name after the divorce even though it said in the divorce decree that I would go back to my maiden name. First question is would that be a concern?? Second question is do I need to provide a copy of the marriage certificate to show my name changing from my maiden name to ex husbands name for the marriage at the time? Pls help, I am planning to submit everything this week! Thank you!

Hi.  If the name you are now using is what you have on your documents, it should not be a problem.  What does your passport, ss card, driver's license/id & etc have?  It's only a problem when the name you are now using is different from some of the documents & they don't match.  I suppose after filling for divorce, your intetion was to change your name back, but decided not to.  After my divorce, I changed my name back through the courts & sent a copy of the name change with my I-129F packet.  I had no problem.  I hope this helps a little bit.  Good luck in your journey.

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

My drivers license and social security card both have my maiden name but my passport I used when traveling to visit my fiancé was under my ex husbands last name even though we were divorced...so like should I not send pics of my passport to avoid any issues? Every other evidence I have is in my maiden name

I worried about the same thing. I've been married twice, but never changed my last name since my first marriage. Do include the marriage certificate that shows the change. Another concern I have, is that I've used a nickname on almost everything, all my life. My legal name is on my driver's license and passport, but my nickname is on my social security card and all my documents from work and taxes. I had my daughter write up an affidavit of same person, which is a letter stating that I use both names. There is a legal way to write this, and many resources online to show you how to do it. It included the amount of time she's known me, and the manner in which I use each name.  She had the letter notarized, and I included it with my I-129f.

I forgot to say that there is a place on the I-129f for you to enter any other names you've ever used. I'm not sure the affidavit of same person was absolutely necessary, but I wanted to cover all my bases.

Yes, send the pages from your passport where it shows the visa stamp for the country you visited to see your fiance.  It proves you actually traveled there.  Also, include any airline receipts, paying for the trip, & of course pictures of the two of you & with friends, & the family members together.  If your birth certificate correctly matches your license & ss card, that's great.  Don't be afraid of sending in little side notes explaining anything that you think might create a red flag or RFE for you.  It's better that they understand everything than to leave questions in their minds about certain things.
