Technically yes, but sometimes less, I would recommend to send a service request follow up after 30 days if you dont hear from them.

Some people follow up after 30 days and it worked for them. Being persistent sometimes works sometimes not, but hey! worth to try.

Do you believe that they might have been something he had failed to mention in that application ? Ticket, make claim to citizenship, Vote Arrest ? If you feel there isn’t anything. Then you can have him wait it out. Already close to the end

So if we withdraw the N400 and reapply next year under 5 year rule is it less scrutiny? Is it easier?

Which is an easier route N400 under the 3 year rule (based on marriage to USC) or 5 year rule? Is there anyone here who married a US citizen and waited out until they were eligible to apply under 5 year rule?

 

Anyone who got denied or withdrew application that was based on the 3 year rule?

We are a legit couple we just don't go out and do much so our relationship doesn't have much of a paper trail except for taxes and lease renewels. At what point do they not focus on the marriage so much?

 

What if he had been a resident for 8 years in example?

If the person got their GC through marriage. They always will look at the marriage part. How much do they look into it depends on each case. Your husband's N400 is already asking for more evidence so even in 10 yrs they most likely will still dig.
