Is the CR-1 or the K-1 best to do in Morocco?

My fiancé and I met online five years ago and met in person for the first time about two weeks ago. He is 24 and I am 34.  Neither of us have been married and I have children but he does not. We have tons and tons of FaceTime and Skype and conversation history for five years but pictures only from the one visit I did meet his family as well. I’m just wondering if the fiancée visa or the marriage visa is the best route in order for it to be approved.  Also I have seen an attorney but it seems like they don’t know much about Morocco specifically.  Do I need an attorney? I don’t want to mess anything up...

K1 would be really difficult for you guys. Young Moroccan guy with a slightly older American woman who has kids from a previous relationship and only one visit? Likelihood of K1 success is almost zero. Even for CR1, your chances aren't that great right now due to the only one in-person visit you guys have had (especially considering it was your FIRST time meeting and it was only 2 weeks ago?!). Before you file for ANYTHING, you guys need to get more visits and in-person time under your belts.

For Morocco , it is always advisable to visit as much as possible before applying, whether you do the k1 or cr1. What I would do regardless of which you decide on , is to visit atleast once more and after this visit ,you can consider filing your petition. The age gap will probably be looked at but not so much of an issue because you are still in child bearing age and this is an important point with this consulate.

 

How long were you there?

Are you divorced?

Do you want children? Does he? 

When do you plan on visiting again?

For either, more visits is needed. One visit alone won't cut it for Morocco, especially having a slight age difference and children in the picture, as it doesn't follow typical cultural norms I wouldn't think for a young Moroccan male.

I understand  and that we need more visits assuming we see each other more (how many more times?) I was thinking the next time I go to get married then I’m not sure what to do from there ... or is it best to continue seeing each other and try to do k-1?

My advice is to slow down.  You have only met once.  More actual time together (more visits) is crucial for receiving immigration visa approvals.  Morocco is a high fraud country, and that embassy is almost always very difficult.  There are many, many cases exactly like yours here.  I would advise you to use the search function to see what others have been through.....good luck.

Everyone who will reply this post will tell you how difficult things will be and they're not wrong. You will have a challenging road ahead either way. But don't we all!? That's why we have each other!!!

 

When it comes to Morocco, I would highly recommend an attorney! I'm not saying pick the first one you meet, "shop around" go to a few consults until you meet someone who you connect with. I have a great relationship with my attorney and he genuinely cares about our case. That's what you need!!!

This process (especially for countries like Morocco) requires a GREAT deal of knowledge, planning, time, patience, and money.......read, read, read.......

We are also planning on going to Korea together as a family and living there. I’m getting my TEFL currently I believe if we are married he may be eligible for an E2 at that point but I’m not sure? I think it’s probably best I start a new thread for that question but this isn’t my main plan...

I am prob biased due to an unsuccessful K1 but I feel CR1 is the way to go for a variety of reasons.

I have been reading and researching and have had 3 consultations.  I understand I need to be patient but we have up once before and I don’t want to give up this time.  I really would like some guidance. Even if he doesn’t make it here we decided to live either in Korea or Morocco together.  I just want to start something since nothing else was started correctly with us in the past(long story mostly about me not having sufficient income to see him or get professional help or sponsor him)

E2 is a whole other beast and technically a non-immigrant visa. That's the extent of my knowledge on E2, but if you're looking to bring you man over to live permanently with you in the US, he needs to fully immigrate. E2 is probably a band-aid solution in your case, not an actual viable solution that's fully applicable to your circumstances. Morocco embassy is notoriously harsh when it comes to K1 visas. Just from what I've read here, I'd say more visits and a CR1 are your best bet.

Lawyers are a waste of money and have no bearing in consulates final decision, they have no impact other than filing which she can do on her own with the help of VJ and people from our consulate.

You can over come any obstacle really with patience and time.

 

Main thing is visits. Proposals and/or weddings on first visits usually are typical red flags, so again something to overcome. More in person visits is main thing you need to overcome these things.

 

As for lawyers, they just cost money. They don't have any power over an embassy so it's just like throwing money down the toilet honestly.

My advice, visit one more time, after this visit then decide on which one you want to go for,cr1 being the better of the two. So, one more visit, come back and plan a return to get married, get married and once you come back file the cr1. You don't need a lawyer, having kids is not the norm yes but because you're of childbearing age that is a plus. Do not get discouraged.
