What you suggest is lying to the immigration and no one will help you with this. 

 

Also even if she doesnt live with you it still might (and should tbh, looks like you have no regards for law ) cause your husband troubles with his work. He really should know better.

Quite common it seems for things not to come up under a FOIA.

 

And people get to the Interview and are asked about there prior issues....

 

What does she have to show she has been living ion Mexico for the last 20 years, you can not live in the US without leaving a paper trail and anyway you have to give details of your prior residences.

I’m not trying to cheat the system, only to understand. 

 

I realize she broke the law multiple times and there are consequences for that. It doesn’t change the fact that she is his mother and he feels responsible to do whatever he can (LEGALLY) to help her situation.

We actually have told her we will financially support her if she returns to MX, as well as allow his minor brother(US Citizen) to live with us. She doesn’t want to do that, so I’m just trying to determine our options (if any) for helping her. We have no intentions of lying to immigration, I’m just trying to fully understand how the process would work.

We have no control over that, I agree she was wrong.

Assuming she is 9C, does sound like she is, then she basically has a 10 year bar outside the US and then to come back will need  a waiver filed by a qualifying relative, spouse, parent are the usual ones. Not children.

 

Dates of entry may be important, 9C came in 1996 I think.

At this point her choices are leave the US or continue to live her illegally. There is no quick and easy fix to this and even if she leaves the US there is no guarantee she will ever be eligible to obtain a green card and return.

I mean she screwed up by hopping the border. What did she think was going to happen?

Well as a non immigrant theoretically, D3 waiver, but practically? What is her skill set?

People must deal with the consequences for their decisions, regardless of what reason they had for doing it, they still did it and should face the penalties to the fullest for it.

 

She might not be able to even get an immigrant visa, the chance of her getting any other sort of visa is basically 0% chance ever at this point.
