That would be a K4 and is very very unlikely, best to get the paperwork in for the Children asap.

I am loathe to comment on such issues when I do not know if the N600K is viable, there are various requirements that need to be met, unclear if they have. I can see issues but probably best not to guess on incomplete information.

The chances are tiny that you would get a K3 and your children will get K4 visas.

 

File the I-130s or waste time by not filing.  The choice is yours.

How do you plan on getting your kids to the US legally for the N600k?  They must be legally present in the US to file for the N600k.  Why pay for the K4 visas and then pay again for the N600k?  


It would be wise to file the I-130s for the kids and have them come to the US and immediately be US citizens.

OP has talked about getting B's, N600K has a list of requirements, some have been covered, some have not. So no idea if it is at all possible.

 I think the uscis will give a letter of notification of oath taking i am not sure if they will send it directly to the US embassy or i will be the one to present it personally upon getting tourist visa for my child

USCIS is not going to give you a letter for oath taking because that doesn't exist.  Why would they give your kids these letters?  Furthermore, tourist visas are not for immigrating to the US.

 

Trying to help you.  Do the smart and simple thing thing and have their USC father file I-130s.  Anything else is a waste of time and money.  Once the kids turn 18, they will not qualify for automatic US citizenship upon entering on immigration visas.  Once they turn 21, it will take 10 years for them to immigrate.  

You came here for advice.  You have been given advice on the best way to get your kids to the US and become US citizens.  K3, N600k, etc. is a waste to time and money.  It could also end up wasting their chances of immigrating to the US if you delay and fail to file the I-130s.

 

The choice is yours.

Only you and your husband know all the details of your children's circumstances.  But based on what you said above, it seems that these particular requirements will be problematic --

 

To be eligible for U.S. citizenship the child must:

  • Be residing outside the United States in the legal and physical custody of the U.S. citizen parent
  • Be temporarily present in the United States in accordance with lawful admission to complete the Form N-600K process and is maintaining that lawful status

 

How will the father satisfy the custody requirement if he lives in California?  Will he move to the Philippines, then move back to the US later to fulfill the domicile requirement for your CR1/IR1?

 

Also, the official site does not mention anything about a B2 visa being automatically granted to the children to be able to fulfill the temporary presence requirement.  What USCIS says about this is:

 

It is the responsibility of the individual seeking the child’s Certificate of Citizenship under INA section 322 to secure any visa or other document necessary for lawful admission to the United States.  USCIS cannot assist in obtaining any necessary visa or other document.

 

I strongly recommend that you and your husband carefully go over the detailed Instructions for Form N-600K as there are many more requirements.  I haven't seen many cases here on VJ of parents filing that, so I have no idea if it can be done successfully without a lawyer.  It's up to you to decide if it will be worth the effort and expense to pursue that route versus the straightforward path to immigration for your children via the CR2/IR2 process.
