LPR trying to sponsor unmarried son- questions

Helli

we are just looking for options.

I’m a GC holder and want to petition my 19yo German son. Does he have to be in Germany to file with me for a visa or can he be in the US (for 90 days) and then file from there while being here as a tourist? Does he have to leave although his petition would be pending or can he stay in the US with me til it’s approved or denied?

he can visit but never overstay, the process will take over 2 years, If immigration doesn't change him to the category F2B when he turns 21

 

if they do the wait is 7 years, maybe more.

 

there is no way to stay legally in the country from an esta or tourist visa.

 

he can try getting a student visa, that would be the only way, but he would have to prove that there is no immigration intent

 

the approval of the i130 is taking in most cases over a year

Unfortunately there are no other legal options...he can't stay in the US pending approval while on a tourist visa/ESTA.  "

 

Worst case scenario is that he "ages out" (turns 21), which adds more waiting time.

Because we don’t have 2 years. We are supposed to leave Europe (husband on military orders) by the end of this year.

i am currently in process of getting naturalized- my N400  status is ‚being actively reviewed‘ 

We‘ve filed under 319b. 

 

It was just crossing my mind if we could take my son and file for him stateside if for some reason the N400 gets denied or takes too long for us. 

Of course we are still hoping for the N400 to get through so I can petition him as a US citizen.

Not to mention your son is legally an adult. Even if he will have to stay behind to wait for his visa, it's not going to be the end of the world.

He'll age out then and it will take even longer. You'd lose nothing by filing I-130 ASAP (other than the filing fee but you'll have to pay that even if you file after naturalization) then you can upgrade it to immediate relative petition when you naturalize.
