Proof of UK residency - for whole processing time?

I am an American currently in the UK on a tier 4 visa.

 

I am aware that I need to show proof of residency in order to file at the USCIS embassy in London. 

 

My British husband and I will file for his CR-1 visa at the US embassy in March 2019 (next month as soon as everything is in order), however my visa expires July 2019 (less than 6 months).

 

- My question - Does my UK residency need to be valid for the whole processing time, or does it just need to be the majority of it? *I plan to reenter the UK as a visitor for 6 months until the processing time is approved as I know that is allowed to do.

 

Thank you for any help! We are feeling lost on this detail.

Your residency only has to be valid at the time of file.  Technically you can file the petition on a monday, have it approved by wednesday and you leave the country friday.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thanks Paul. However, it’s not that quick to get approved is it? Or are you just speaking hypothetically? Thanks.

For the USCIS part it should be very quick.   In our case, albeit Mexico and the busiest of posts for immigrant visas, I filed on a Friday, left with the receipt / NOA1 in hand.   We got the emailed NOA2 the following monday. 

 

Once the case is done at USCIS it goes straight to the Department of State and not the NVC.   If your visa expires during that time and you leave it is ok.   You can come back later on a tourist visa anytime.

 

I took everything I could to prove my and her legal status in Mexico as she was a third country national.
