CR1 visa approved but passport returned to Courier

They initially approved my fiance and then called him back a few days later to interview him again.  He ended up being denied after the initial approval due to misrepresentation that we disclosed with our petition. 

 

I agree with dwheels- ask a lot of questions to find out what the concern may be!

@Unshakable Faith,I was just reading ur timeline. So they denied it the first time but then approved it second time ? Why would they do that ? I really wish they realize they are playing with peoples life & not just papers. Would you mind sharing why it got denied the first time around.  ?

When we petitioned the first time in 2015, we disclosed some previous material misrepresentation on the petition.  When our interview finally came in June of 2016, they initially approved him.  A few days later he received a call to come back in for follow-up questions and they denied him but gave the option to file the I-601 waiver.  We filed that and were approved.  Normally they just ask for the passport to issue the visa if it has been less than a year, but they called him back in for another interview after he did a second medical exam.  When he went for the interview in April 2017, they denied him even though we had an approved waiver for the misrepresentation.  They said our petition was expired and they weren't convinced we had a bonafide relationship because of the misrepresentation- although the misrepresentation was covered by the waiver.  We petitioned again in April of 2017 and had an interview in March of 2018.  He was put into AP and asked for more documents to prove his identity.  We turned it in a few days later and I followed-up almost every week via email and also had my senator reach out frequently.  Thankfully, my senator had been working through the case with us since our first petition because in 2015 there was a huge backlog and petitions were taking almost a year to approve.  We were in AP from the beginning of March until the beginning of May before we were approved.

 

OP, AP does not mean that all hope is lost.  I just saw a fellow user on here that was placed in AP after approval and was just emailed to submit his passport so they can issue the visa.  He was in AP for a month or so.

 

AP does not have a time frame but my suggestion would be to ask your husband specific questions like dwheels had suggested.  Specifically ask him if he has ever been to the embassy before you met, has he ever given false information, does he any children, any prior marriages, etc.  Talk about the interview and the exact questions he was asked, did they question about any point specifically.  Then look at your case and the red flags you might have.

 

Keep the faith, study yourselves well and see if there's anything you could think might be the issue.  Contact your senator and have them inquire about the AP.  Usually the senator's have places on their websites to fill out forms for agency assistance- it might be under "constituent services" or something of the like.

04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

It depends on the ticket purchased and the airline's policies regarding non-refundable tickets.  The details are in the fine print.  Sometimes a non-refundable ticket can be changed for a fee, sometimes not.  It all hinges on the type of ticket and the rules for it.  It's always best to wait until the visa is in hand before making any travel arrangements.  It's not over until then.  Anything can happen, as did in this case.
