Tourist Visa valid and thinking of Petitioning

Yup.  No visas or visa interviews are done within the US.

Timeline

A tourist visa can be adjusted to a resident visa within the USA by way of marrying a US citizen but the alien has to prove it was not his/her intent to marry when they entered the USA. That is the tricky part.. My wife entered the USA with a tourist visa, we met a couple of months later and married about four months later. She had a good job back home, came to visit her sister for the holidays. I worked with her brother-in-law and knew the family but had never met the sister. In those days, before 9/11,  things were easier. For today's situation read the website below...

LOL, I realize people can adjust from a B visa.  However, she won't be interviewing at a consulate for a "visa," unless she returns to her country.  She will be seeking to adjust status from within the US through you.  No more visa involved.
