Is the k-1 visa the best path to take in this relationship?

It seems as though you are leaning towards the CR1 route if you guys choose the US (which I would also recommend in your situation). But I wanted to add in case you do choose the K-1. After you marry and send the AOS, AP, and EAD packet you may be able to get your EAD expedited if you’re interested in staying with your current company (since you said they are a US company and you work from home). If it’s a solid job offer it wouldn’t hurt to try for an expedite. Regardless of expedite you can’t work in the US until you have your EAD though. Good luck to you both no matter what avenue you ultimately decide on! ☺️

Completely false! Nothing wrong with getting married as a visitor. The fraud only comes into play if someone enters the US without an immigrant visa but with the intention of staying. That’s the fraud. 

 

Many of us here (myself included) got married in a visit to our loved ones.

The K1 and CR1/IR1 visas are for immigration - permanent residency.  If you don't intend to live in the US then just keep using your ESTA to visit the US.  You will need to prove strong ties to where ever your residency is tho.

Many of us here (myself included) got married in a visit to our loved ones. 

Most people I know have done it that way.  Most of them came to visit without the intent and then 2 months or so into their visit they got married.  But anyways I suggest to the person a few things.  If your girlfriend is willing to move to the Netherlands it will be alot easier.  Maybe you guys could live together in the Netherlands for two years and then immigrate to the USA on a IR1-10 year visa vs you guys being apart and applying for a CR1-2 year visa.  Current the removal of conditions is taking longer and longer for the CR1 (when its time to remove conditions - which is putting alot of stress on families that have to walk around with an extension letter for 18 months. )  Just something to think about.  The fiancee visa I personally think its a waste of money and time.  Things are getting so backed up with immigration that the fiancee visa in alot of scenarios are taking just as long to process as a CR1 or IR1.  Then on a fiancee visa you wont be able to immediately work in the USA for god knows how long.

Can't seem to update my main post, but here's an update just in case.

At first we thought living in the US was the way to go since my gf has her pets over there and I know english. But, we both agreed that living in the Netherlands would be more than fine. Also cheaper. We just have to figure out everything with getting our pets over here in the netherlands, and then we have to figure out all the things to have my future wife be able to stay and live here with me. That is our current goal. There is no desire really to live in the US. Maybe one day if we change our minds.
