Married K1, Don't want to file AOS, wife fighting to stay

Timeline

Married to Filipina back in September.

We are not compatible being married at all. We are very different. 

I did not file AOS because I want a divorce.

She is not living with me. 
She wants me to file the AOS while we are separated but that is fraud.
My wife refuses to leave and her visa is expired.

She wants to fight for her rights to stay in the USA.

She can't stay because I didn't file the AOS.

 

What can I do to protect myself?

She refuses to go back to the Philippines.

She said she was going to contact the government for help.

Is there an easy way to send back her to the Philippines?

I agree with @Ben&Zian.   I would stay away from her......Her best chance of remaining in the US is to find a reason to claim abuse....and that could get you into big trouble.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I will chime in that to cover yourself, you’ll want to maintain distance from her.  Document anything that happens & call the police if she shows up.  

 

Most importantly, file for a divorce.

Stay away from her. All communication over text so you have record. Write to USCIS with your case number and tell them you are not adjusting her because the marriage is over. File for divorce. Whether she leaves or stays is not your problem.
