Medicaid for conditional LPR

Correct. It's not that emergency Medicaid is only accessible to those without legal status...it's that most legal non-citizens qualify for regular Medicaid there so they are required to use that instead. Only those who don't qualify for regular Medicaid in NY can qualify for Emergency Medicaid there.

In CT emergency Medicaid is only for those undocumented as well. It is state specific.

This. Yes. Emergency Medicaid is for those (non documented) who wouldn’t have access to Medicaid and meet the income limit. Residents/citizens qualify for Medicaid as long as they are not over the income limit. No need for emergency there- and if they make over the limit and choose not to have insurance then they are self pay for medical visits. Many medical facilities will work out a payment plan or have a discount/sliding scale based on your income. I can only speak for CT though as all states are different.

Basically your options seem to be:

1) get her on regular Medicaid ASAP and hope it will cover medical bills going back 3 months (it usually does)

OR

2) set up a payment plan with the hospital and slowly pay off your bill

Those that “legitimately” come here for birth tourism pay for their medical care. Those that are deceptive, well, we pay unfortunately.

Out of curiosity why is your wife not on your insurance? That would have solved your troubles   If you recently got married- that qualifies as a “life changing event” and depending on the time period she can be added.

 

The proposed law that has been posted here (again-just proposed) could hurt her chances of becoming a citizen/adjusting her status in the future if put into place. Currently, however, Medicaid is not considered a public charge.

 

I know you also mentioned back dating the Medicaid- it is possible they will only backdate it to the first of whatever month you applied. For example if you apply and qualify today they may backdate it to Feb 1.

I'm not sure what backdating is but medical bills are usually covered 3 months back. Also, OP's wife is a LPR so no need to adjust her status.

I did misspeak- yes, many states allow backdating/retroactive medicaid for 3 months back if you were eligible however it is state specific- some states recently eliminated this 3 month backdating.
