Documents received by uscis September 20, 2018 still no EAD. Biometric done november 20

We are getting pretty frustrated. My wife really wants to work, we have a 3 year old that goes to preschool and she wants to help support her family back home. I looked into getting her EAD expedited and since she is unskilled worker chances look slim.

 

Can anybody give me an idea what to expect or some advice to get things moving? We got the receipts and never had any RFA (which is good) but our time is taking much longer than some of our other friends.

Sorry to say but you will have to wait. Part of the process going to k1 route. If English isn’t her first language look for classes for her to take to fill her time.

Unless you're well outside the processing time, I don't know that contacting your congressperson will do much, though you can certainly try.

 

Honestly, 4.5 months doesn't seem out of the ordinary when many EADs/APs are taking over 5. You could request an expedite if she has a job offer or provides evidence of severe financial hardship should she not get it soon, but approval for those reasons seems unlikely in your case.

Nothing you can do at this point really. I am a September 12 filer (received date 9/12, NOA date 9/18) and got my EAD/AP approved yesterday. So I think you're going to get a decision shortly! Hang in there, most people wait 5,5 months for EAD/AP

Can get help from a congressperson with a job offer. But the challenge is getting a job offer that's willing to wait on help from your congressperson.

Unfortunately, it takes 4-6 months.  If you fill in your timeline here, you will get an estimate for when to expect the EAD/AP.  My husband's biometric was 11/30, and our estimate is showing April.

Wow, this gives us a little hope! Seems like at this point the Congresswoman thing would be a lot of work for something that may be on the way within the next few days/weeks. 

 

So the fact that we have not gotten any RFA's means that everything is more than likely squared away? We have several friends that received RFA's a few months after they had sent their initial paperwork in.  Also, when would we find out if an interview is necessary? We have a very strong case with a lot of paperwork (proof we lived 4 years in PI together, A child, joint bank, both names on rent ETC.) Strong paper evidence, not anecdotal pictures and stuff.

You can use one if you're severely outside the processing time, you're perfectly on schedule.

Strong paper evidence, not anecdotal pictures and stuff. What are you adjusting from? If it's from K1 your wife won't get an interview for EAD/AP, just AOS. Also, the RFE's can be send at any time. Mine was send out right after I filed AOS so I got very lucky, but some people get them and right after they respond get their approval. Don't worry too much about it, there's not a lot you can get an RFE for when you file for EAD.

 

Also, please fill out your timeline so we can help you better, it's really hard to advise people when there's no info available

I was doing the timeline couldn't remember some of the dates and when I went back saw that my I485 was "ready to schedule an interview".

 

Since the i485 is ready to schedule and interview does that mean that there are no RFE

 

So as far as the EAD goes does that typically update around the same time? 

 

My wife keeps saying that her friends are saying she is "Direct to Greencard". What does that mean and is there any truth in that? 

 

It's just nice to see the ball rolling! Thanks for taking the time to answer my questions.

Ready for interview does mean that your I-485 is complete and you're in the que at your local office for an interview. Depending on your field office it can take 1+ year to get an interview, some field offices are faster. You can check the estimated processing times of your local field office via https://egov.uscis.gov/processing-times/.

 

Once the EAD/AP is approved the status usually changes to 'card is being produced' and/or 'we approved your case'. Keep in mind that online sometimes there's a delay but they usually do update the status.

 

No clue what 'direct to green card' means. She has to go through the process like everyone else that came here on K1.
