K-1 visa rejected twice since 2017

Hi everyone

 

My brother in law filed  a K-1 fiance visa for his fiancee in April 2017 (He's a U.S citizen and fiancee is in Pakistan), USCIS had objection that they haven't met in last two years (which is probably a requirement for this visa), so we provided them with pictorial evidence of engagement which was held in September 2017 in Pakistan after fling the petition in USCIS. But petition was rejected. 

They applied again in March 2018, this time they passed the USCIS stage and case was sent to embassy. After interview, case was in administrative processing for 1 and a half month. Unfortunately, visa was rejected this time. 

 

We are not sure what is the problem? and are confused that should we appeal or re-apply again on the same visa category or my brother in law should apply on spouse visa? will these rejections have effect on her spouse visa?

 

Visa Journey has been such a great help during my own visa processing. I am in U.S now and hope that you guys can help and give suggestions this time as well.

  In many cultures the engagement ceremony is seen as been  too committed to be considered single.  At this point he is too married for a K1 and not married enough for a CR1 .    Hate how they split hairs.  He will probably have to go back and have a full marriage  and try again.

This will not be over quickly. You will not enjoy this.

There is no appeal for K1 visa. Before thinking about apply again they should find out why they were denied so they can over come this.

Most likely, just from what you have informed us of, the visa was rejected as it appears they are "too married" for a fiance visa, but not "married enough" for the spousal visa

 

Best bet is for them to go officially marry and file for the CR-1 visa.

 

There are countless stories of people being denied because of local/customary celebrations being done because a lot of them signal that the couple is in fact wed even if no paper work is done. So we always advise against such things.

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

What kind of engagement was this, a traditional engagement ceremony? If this was the case then that is more than likely the reason it was denied at the embassy because they will consider him to married for the K1 visa. This is actually a pretty common issue in regards to the countries in the Indian Subcontinent such as India, Nepal, and Pakistan. The best bet right now is for them to get married and file the CR1.

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Yeah, it was a traditional ceremony with around 150-200 guests.

So, I there appears to be a lot of speculation point to the belief it looks/appears no have been a wedding. However, at this point there is not definitive reason. HMM1234 is asking about his brother. Perhaps he is unaware if was AP or what. I did not here him say airlines tickets, boarding passes, or copies of visa from passport were sent with pictures. I’m sure many of us who have came near interview or visa has said “If what I know now, I had known when I started it would have been, less stressful, easier, and quicker to do”

I truly believe this thread has a powerful point.  Don’t Do Anything that has any kind of resemblance to a wedding, being official or whatever. If you live in like Texas, and have a BBQ and the preacher shows up because he’s always ready for some ribs & brisket—some CO from Vermont is going to say “looks like a wedding to me”

 

Just be very careful what your family events look like.

 

Sounds like you need more information from brother so folks here a better picture of what the issues might be a best way to deal with it.

 

What Ann & James said is the best answer “There is no appeal for K1 visa. Before thinking about apply again they should find out why they were denied so they can overcome this”.

 

First define the problem.

The Islamabad embassy is very difficult to get a K-1 visa from. My fiance was denied from there. We are getting married and then filing an i130.

Not a great idea.  They should marry and file for a CR-1.  Even that may take years, so he may want to prepare to move back to Pakistan.
