Manila Embassy, Tax Transcript Requirement

As others noted, this is not the case for a K-1 visa. The only requirement under the law for a K-1 is that the CO must be convinced that the applicant will not become a public charge. A CO can make this determination without tax trascripts, or without an I-134 even. As described above, Manila has not been asking for this regularly for years. My now-wife was not asked for it either.

 

COs at other consulates have regularly requested an I-134 w/ tax returns. That's their process to make the decision.

 

This differs from an immigrant visa case which uses an I-864. That form is required under the law in those cases, which does have a requirement for tax returns.

W-2 ..... unless a person has multiple employers, there is only ONE W-2 each year.

 

There is no factual evidence of an embassy requiring tax transcripts only .. and surely not ALL embassies.   USEM has enforced many requirements that other embassies didn't plus went against what was posted on the Dept.of State websites even.

 

Can't use a broad paint brush ..

As for Manila embassy,they hardly even ask to see any financial form or documents*, which I wish they really would. They have their own standards as each embassy has their own elsewhere. Some are stricter than others.

 

* with the K-1 visa.    Does not hold true for immigrant visas

So if a transcript will cover all bases then why not use it to prevent any delay? I prefer to keep the process in motion than to face a delay.
