Chances of getting AP?

So I sent off my AOS packet this morning, along with the EAD and AP applications. My question is are there any reason why I wouldn't get the combined card and would be denied AP?

My wife was reading up about AP and thought it was a waste of time to even apply for it - but since I joined VJ and have been reading through other people's experiences I didn't see the harm in applying considering it was free along with the EAD and AOS.

On the AP form I filled in "UNKNOWN" for date of travel and "N/A" for length of stay as some people suggested on here, and then wrote a statement that I would be going to Canada and UK at various times in the next year to visit family accompanied by my wife.

Most people get AP because like you said, it's free. It allows you to travel and come back while waiting for your green card. The I-485 may take a while to be adjudicated and you may be called for an interview and then wait some more. Anyway, AP allows you to travel during all that. What if there is an emergency you have to go back? It is always better to have something ready.

I understand that - I'm just asking if there is a reason why I wouldn't be accepted for it? My wife read that you must have exceptional circumstances to be allowed AP.

Not sure where she read that.  Assuming you filled out the form correctly you should not have a problem being approved.

No, why wouldn't you be accepted? AP is a routine thing. You do not have to have exceptional circumstances. You just have to give them a reason, could be any reason. Generally "I want to visit my family or my dog or my lover" whatever would be fine

When you file the I-131 together with I-485 you don't need a reason. So you're fine.

 

The I-131 requires a good reason in some other situations though, but not when filed together with a i-485.

People die tragically and unexpectedly. Gran gets diagnosed with cancer.  It's not whether you are planning a trip. It's the unplanned ones that might come up.

When my lawyer filed for AP she wrote "Emergency" under which circumstances I would be allowed to leave. Does that mean I cant leave just to visit family or go on a honeymoon outside of USA until I have my GC? If yes, does anyone have a clue how long that takes atm from AOS filing?

Without AP or green card or equivalent stamp on your passport, once you leave the USA, you are deemed to have abandoned your application for a green card and must start all over again, this time with the CR-1 visa.  You will not be admitted to the USA again until you have the CR-1 visa. 

 

The AOS interview can take 7 months or more from filing.  Assuming a positive decision, at the time of interview you might get the stamp on your passport that lets you travel. The green card comes a few weeks after the interview.  

 

Thus  getting the AP document is imperative.  

 

If a family emergency happens before the AP document shows up, you can get an emergency AP from USCIS.
